HomeMy WebLinkAboutOrd 635 Amending Chapter 30 Courts as it relates to Driving Safety FeesTOWN OF WESTLAKE ORDINANCE NO. 635 AN ORDINANCE OF THE TOWN. OF WESTLAKE, TEXAS, AMENDING ORDINANCE NO. 401 AS IT RELATES TO SECTION 9 AND THE ASSESSMENT OF DRIVING SAFETY FEES FOR THE MUNICIPAL COURT OF RECORD NO, 1 IN THE TOWN OF WESTLAKE; WHEREAS, the Town of Westlake Town Council established the Municipal Court of Record No. 1 and allowed for the assessment of an administrative fee for defendants who request a defensive driving course according to the laws of the State of Texas; and WHEREAS, Ordinance No. 401 also sets forth the collection of the $10.00 administrative fee in accordance with the state law. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: - SECTION 1. That the Town Council hereby amends the administrative fee to reflect the collection of a non-refundable fee in the amount of nine dollars and ninety cents ($ 9.90) as a special expense each time a person request a driving safety course for the purpose of having the charge dismissed after the successful completion of the course. The fee shall be paid into the Town treasury to recover the costs incurred by the Town in processing the person's request for a driving safety class. SECTION 2. That this Ordinance shall be cumulative of all other Ordinances and shall not repeal any of the provisions of such Ordinances except for those instances where there are direct conflicts with the provisions of this Ordinance. Ordinances or parts thereof in force at the time this Ordinance shall take effect and that are inconsistent with this Ordinance are hereby repealed to the extent that they are inconsistent with this Ordinance. SECTION 3. If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or application thereof to any person or circumstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the Ordinance, and the Board of Aldermen hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 4: All other Ordinances in effect and not in conflict with this Ordinance shall remain in full force and effect. SECTION 5: The Town Secretary of the Town of Westlake is hereby directed to engross and enroll this Ordinance by copying the exact Caption and Effective Date clause in the minutes of the Town Council of the Town of Westlake and by filing this Ordinance in the . Ordinance records of the Town. Ordinance 635 Page 1 of 2 SECTION 6: This Ordinance shall take effect from and after its date of passage in accordance with law, and it is so ordained.
