HomeMy WebLinkAbout08-27-07 ZBA MinMINUTES OF THE TOWN OF WESTLAKE, TEXAS ZONING BOARD OF ADJUSTMENT August 27, 2007 PRESENT: Board Members Larry Corson, April Gallagher, Pete Steger, Bob Timmerman ABSENT: Board Member Don Redding. OTHERS PRESENT: Town Manager Trent Petty, Town Attorney Stan Lowry, Town Secretary Kim Sutter, DPS Director Don Wilson, and Facilities Director Troy Meyer. 1. CALL TO ORDER. Member Steger called the meeting to order at 6:54 p.m. 2. REVIEW AND APPROVE MINUTES OF THE MEETING HELD ON MARCH 26, 2007. Member Steger introduced the item and asked for a motion. MOTION: Member Gallagher made a motion to approve the minutes as presented. Member Timmerman seconded the motion. The motion carried by a vote of 4-0. 3. CONDUCT A PUBLIC HEARING AND TAKE APPROPRIATE ACTION REGARDING AN APPLICATION FOR A VARIANCE REQUEST REGARDING ALLOWABLE HEIGHT AND PLACEMENT OF A SOLID MASONRY FENCE/ SCREENING WALL, LOCATED AT 1606 FAIR OAKS DRIVE IN GLENWYCK FARMS ADDITION, BLOCK A, LOT 26. Member Steger introduced the item. Town Manager Petty advised the Board of the case and stated that solid fencing higher than 3.5 feet in front of a building setback line is prohibited by the code, and the Board Town of Westlake Zoning Board of Adjustments August 27, 2007 Page 2 of 2 must decide if the request constitutes a legal hardship subject to the evidence presented by the applicant. Mr. Danny Vogt, the applicant and owner, was present to address any questions of the Board. Mr. Vogt advised the Board that he is proposing placing an eight (8) foot, solid masonry wall across the back of his property in an effort to reduce noise and disturbances from the increased traffic at the intersection at Randall Mill and Dove Roads. Member Steger opened the public hearing. There being no one requesting to speak, Member Steger closed the public hearing and asked for a motion. MOTION: Member Corson moved to grant the variance request for an eight (8) foot, solid masonry wall as he feels a hardship exists based on the evidence presented. Member Gallagher seconded the motion. The motion carried by a vote of 4-0. 4. ADJOURNMENT. There being no further business to come before the board, Member Steger adjourned the meeting at 7:05 p.m. Approved by the Zoning Board of Adjustment on March 24, 2008.
