HomeMy WebLinkAboutRes 93-05 Authorizing an Agreement with the Tarrant County Health DepartmentRESOLUTION NO. 93-5 A RESOLUTION AUTHORIZING AN AGREEMENT WITH THE TARRANT COUNTY HEALTH DEPARTMENT TO INSPECT FOOD ESTABLISHMENTS AND PUBLIC SWIMMING POOLS TO BECOME EFFECTIVE ON AND AFTER THE DATE OF ITS PASSAGE AND APPROVAL. WHEREAS, the Town of Westlake has previously entered into a contract with the Tarrant County Health Department to inspect food establishments and public swimming pools within the corporate limits of the Town of Westlake; and WHEREAS, the Town desires to renew the contract. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That the Mayor of the Town of Westlake is hereby authorized to enter into a contract with the Tarrant County Health Department for the inspection of food establishments and public swimming pools within the corporate limits of the Town of Westlake. SECTION 2: A copy of the contract is attached hereto as Exhibit "A". SECTION 3: This Resolution shall become effective from and after its passage as provided by law. County hereby makes available to City for the protection of its residents Food Establishment and public swimming pool Inspection Program Services through the Tarrant County Health Department. 2. The Tarrant County Health Department will provide its services to all food establishments and public swimming pools located within the corporate limits of said City during the terns of this agreement_ The said services shall consist of a food establislunent and public swininung pool inspection program, certification of establishments for issuance of hcalth permits, collection of fees, notification to City of violations of health ordinances, documentation of program activities within City in a quarterly report, and, where legally required by ordinance, approval of food establishment and pool managers and employee training, and certification 3. " The term of this agreement is for a period of one (1) year commencing on October 1, 1994, and ending on September 30, 1995, unless either the County or the Qity provides thirty (30) days written notice to the other that an amendment or termination is necessary. This contract is renewable by Tan-ant County Commissioner's Court Order and approval by 'town of Westl ake's city council This approval will be documented by a letter signed by both the County Commissioners and the City Council. 6. County is an independent contractor under the terms of this agreement and is not an officer, agent, servant, or employee of the City. The City shall be responsible for enforcement of the City's health ordinances. 7. To help understand the changes I have included a copy of the new inspection sheet and a sheet that highlights several changes. 1) The old rules had 44 items with a variety of point values from 1 to 5. The score of items violated was subtracted from 100. The new rules do not subtract from 100;the total number of points debited is reported. This was done partly because not all of the items applied to all establishments. Limited service operations were essentially given free points because some items would never be marked. When these numeric scores were compared to service establishments, an uneven picture resulted. While we never recommend comparing just the numeric scores, it is a common practice and reporting only the debited items improves the situation. 2) On the new inspection sheet, only items that relate to potential foodborne illness are scored, other items are noted but not scored. A dirty wall may be an indicator of poor management, but a dirty wall does not directly affect the safety of the food and would be listed as a non-scored item. A dirty food contact surface would be scored. I again offer my services to make a presentation to the city council and staff members if you feel it would be helpful. The rules represent the next step in safeguarding the food supply for our citizens. Due to a change in both substance and format, I will need to visit with you or your staff and the city council to work out a transition for your city. The rules represent the next step in safeguarding the food supply for our citizens. Due to a change in both substance and format, I will need to visit with you or your staff and the city council to work out a transition for your city. The most visible changes will probably be: 1) different scores 2) scores reported differently 3) the number of inspections will drop initially as our staff takes the time to explain the new regulations to food service operators A second area of concern for many of our contract cities involves the new state swimming pool regulations. If we perform those inspections in your area we can discuss that at the same time. So far, this year has been ideal for mosquitoes; repeated, moderate rainfall separated by a few days of dry weather. This has resulted in numerous calls from citizens concerned about possible public health implications of the large numbers of mosquitoes. Fortunately there has only been one isolation of St. Louis Encephalitis in a sentinel bird flock as of today. The subject bird was in south Dallas and no additional tests have been positive. We are therefore considering the mosquito problem as a nuisance condition and maintaining a careful watch to determine if it is becoming a public health problem. Our first step has been to move classes from the Health Department Building to several locations throughout the county. We have tried to find locations that will be convenient to all of our contracting cities. The new locations and schedule will be reevaluated to see if we should add, move or reschedule classes. Due to the questions arising about the boundaries of Westlake, the builder was unsure as to who to contact for the required permitting of OSSFs in the area. The Tarrant County Commissioners Court is the authorized agent for all unincorporated parts of Tarrant County. Any incorporated area that wishes to perform their own inspections must receive permission to so from the Texas Natural Resources Conservation Commission. I have enclosed three copies of our standard contract for services and a fee schedule. There is no cost to the town as we charge the applicant our standard permit fee(s) for the permit. Said inspections and permitting shall be in accordance with all local and state laws. SECTION 3. In consideration for the inspection and permitting services provided, as well as the administrative costs incurred, Town agrees to allow County to charge its standard application and permit fees and to retain one hundred percent(100%) of all fees collected. SECTION 4. In the performance of this agreement, it is agreed that County shall have no supervisory authority over any Town agent(s), employee(s) or officer(s) and that neither County nor its agent(s), employee(s) or officer(s) is subject to the control of Town in the performance of the duties undertaken herein. This agreement contains all commitments and agreements of the parties hereto, and no other oral or written commitment(s) shall have any force or effect if not contained herein. It is expressly understood and agreed that, in the execution of.this agreement, neither Town nor County waives, nor shall be deemed hereby to waive, any immunity or defense that would otherwise be available to it against claims arising in the exercise of governmental powers and functions. 2 SECTION 5. The Division's emergency pager is assigned to a Health Department Consumer Health Specialist on a rotating basis. The assigned emergency responder will respond to the site after the emergency is brought under control, i.e., fires, accidents or natural disasters involving restaurants, grocery stores, or other food operations. STATE OF TEXAS COUNTY OF TARRANT WHEREAS the governing bodies of the parties herein finds the following agreement in the best interest of the citizens they serve and WHEREAS Article 3, Section 64 of the Texas Constitution and Chapter 791 of the Texas Government Code authorize Counties and Cities in the State of Texas to contract with one another for the performance of various governmental functions and services including those in the areas of public health and welfare and WHEREAS TARRANT COUNTY and the TOWN OF WESTLAKE pursuant to the Constitution and the laws of the State of Texas desire to make and enter into a contract whereby Tarrant County will make available to the TOWN OF WESTLAKE Food Establishment and Public Swimming Pool Inspection Program Services for the public health protection of its residents, NOW, THEREFORE KNOW ALL MEN BY THESE PRESENTS: TARRANT COUNTY, hereinafter called "County", acting herein by and through TOM VANDERGRIFF,duly authorized COUNTY JUDGE as directed by the Commissioners Court of Tarrant County, and the TOWN OF WESTLAKE, a municipal corporation situated in Tarrant County, Texas, hereinafter called "City",acting herein by and through SCOTT BRADLEY, its duly authorized MAYOR, do hereby covenant and agree as follows: 1. The County hereby makes available to the City for the protection of its residents Food Establishment and Public Swimming Pool Inspection Program Services through the Tarrant County Health Department. 2. The Tarrant County Health Department will provide its services to all food establishments and public swimming pools located within the corporate limits of said City during the term of this agreement. The Tarrant County Health Department agrees to provide appropriate signs to be posted at public food establishments and public swimming pools or spas that do not meet the standards of the Health Department as specified in the ordinances of the TOWN OF WESTLAKE. Such signs shall state that the facility does not meet Health Department standards and shall contain such other information as needed to inform the public that the facility has failed to meet health standards. Tarrant County Health Department shall notify the TOWN OF WESTLAKE about this action. 3. The said services shall consist of a food establishment and public swimming pool inspection program,certification of establishments for issuance of health permits, collection of fees, notification to the City of violations of health ordinances,documentation of program activities within the City in periodic reports, and where legally required by ordinance,approval of food establishment manager training,food handler training and pool operator training and certification. 4. The City agrees to maintain during the period of this agreement ordinances which: adopt the current Texas Board of Health"Rules on Food Service Sanitation" and"Rules on Retail Food Store Sanitation"; designate the Director of the Tarrant County Health Department as Health Authority for the purposes of this agreement; require all food establishments within corporate limits to maintain a valid health permit; adopt health permit fees of$150.00 annually for each food service and retail food establishment that engages in food preparation, $100.00 annually for each retail food establishment that does not engage in food preparation, and $35.00 for each temporary food establishment; assign to the Tarrant County Health Department the authority to collect health permit fees from permit applicants; and require food establishments to have certified managers and food handlers when required by law. 5. The City agrees to maintain during the period of this agreement ordinances which: adopt the current Texas "Minimum Standards of Sanitation and Health Protection Measures", Title 5, Chapter 341, Subchapter D, Section 341.064 of the Texas Health and Safety Code and"Design Standards for Public Swimming Pool Construction", 25 TAC, Chapter 337, Sections 337.71 through 337.96; designate the Director of the Tarrant County Health Department as Health Authority for the purposes of this agreement; require all public swimming pools and spas within the corporate limits to maintain a valid public swimming pool permit; adopt public swimming pool permit fees of$100.00 annually for each public swimming pool and spa; assign to the Tarrant County Health Department the authority to collect public swimming pool permit fees from permit applicants; and require facilities to have certified pool operators when required by law. 6. If during inspection of a food facility, pool or spa, Tarrant County notices a violation of the City's code, the Tarrant County Health Department shall notify the appropriate City official. The City shall be responsible for enforcement of the City's health ordinances. County employees whose testimony may be required for such enforcement pursuant to the Agreement shall present themselves for testimony in any such enforcement action taken by the City in accordance with the procedures established by WESTLAKE'S MUNICIPAL COURT for the appearance of law enforcement officers. 7. This agreement shall begin upon the approval of both the City Council and the Tarrant County Commissioners Court and shall continue until canceled by a minimum of 90 days written notice from either party. 8. The County is an independent contractor under the terms of this agreement and is not an officer,agent, servant,or employee of the City. No employee of the County shall be an officer, agent, servant, or employee of the City as a result of this Agreement. 9. No funds or money shall be due to Tarrant County from the City as a result of this Agreement. Tarrant County shall receive its total payment for services provided from the collection of permit fees as stated within this Agreement and as authorized by ordinance of the City. The City shall immediately notify the County of any change in fees as authorized. County hereby makes available to City for the protection of its residents Food Establishment and public swimming pool Inspection Program Services through The Tarrant County Health Department 2. The Tarrant County Health Department will provide its services to all food establishments and public swimming pools located within the corporate limits of said City during the term of this agreement. The said services shall consist of a food establishment and public swimming pool inspection program, certification of establishments for issuance of health permits, collection of fees, notification to City of violations of health ordinances, documentation of program activities within City in a quarterly report, and, where legally required by ordinance, approval of food establishment and pool managers and employee training, and certification. 3. The City agrees to maintain during the period of this agreement, ordinances which: adopt the current Texas Board of Health 'Rules on Food Ser,ice Sanitat;on" and "Rules on Retail Food Store Sanitation"; designate the Mor of the Tarrant County Health Department as Health Authority for the purposes of this agreement; to require all food establishments with corporate limits to maintain a valid health permit; adopt health permit fees of$150.00 annually for each food service and retail food establishment that engages in food preparation, S100.00 annually for each retail food establishment that docs not engage in food preparation, and $35.00 for each temporary food establishment; assign to the Tarrant County Health Departrmtent the authority to collect health permit fees directly from permit applicants; and where not precluded by law, require food esuiblishments to have certified tnanagers and etnployees. 4. The City agrees to maintain during the period of this agreement, ordinances which: auopt the current Texas Minimum Standar( Sanitation and Health Protection Measures, _ __ 5, Chapter 341, Subchapter D, Section 341.064 of the Texas I Iealth and Safety Code, and Design Standards for Public SWirnming Pool Construction, TAC, Chapter 337, Sections 337.71 through 337.96; to designate the Director of the Tarrant County Health Department as Health Authority for the purpose of this agreement ; to require all public swimming pools and spas within the corporate limits to maintain a valid public swimnung pool permit ; to adopt public swimming pool permit fees of$100 armualty for each public swimnung pool and spa ; to assign to the Tarrant County Health Department the authority to collect public swimnung pool permit fees directly from permit applicants ; and where not precluded by law, to require facilities to have certified pool managers. S. The term of this agreement is for a period of one (1) year commencing on October 1, 1994, and ending on September 30, 1995, unless either the County or the Qity provides thirty (30) days written notice to the other that an amendment or termination is necessary. This contract is renewable by Tarrant County Commissioner's Court Order and approval by Town of Westlake's city council. This approval will be documented by a letter sighed by both the County Connnissioners and the City Council. 6. County is an independent contractor under the terms of this agreement and is not an officer, agent, servant, or employee of the City. The City shall be responsible for enforcement of the City's health ordinances. 7. This contract is renewable by Tarrant County Commissioner's Court order and approval by 'Down of Wast t aka'G city council.
