RESOLUTION NO. 12-34
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE,
TEXAS, AUTHORIZING THE TOWN MANAGER TO EXECUTE A CONTRACT
WITH GRAHAM ASSOCIATES FOR ENGINEERING DESIGN AND CONTRACT
MANAGEMENT SERVICES FOR A 1MG GROUND STORAGE TANK.
WHEREAS, the state requires water purveyors to provide a safe and adequate supply of
water to citizens and water customers within their geographic service area; and
WHEREAS, the Town Council find that the design of a secondary ground storage tank is
sound infrastructure planning consistent with goals and objectives within the adopted strategic
plan; and
WHEREAS, the Town Council finds that the engineering work related to the
construction of a secondary ground storage tank is necessary to successfully complete the project
and that funding is appropriate; and.
WHEREAS, the Town Council finds that the passage of this Resolution is in the best
interest of the public.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF WESTLAKE, TEXAS:
SECTION 1: That, all matters stated in the Recitals hereinabove are found to be true
and correct and are incorporated herein by reference as if copied in their entirety.
SECTION 2: That, the Town Council of the Town of Westlake, Texas, hereby approves
the contract, in the amount of $88,685 for engineering services related to the construction of a
ground storage tank attached here to as Exhibit "A", and further authorizes the Town Manager
to execute said contract on behalf of the Town of Westlake, Texas.
SECTION 3: If any portion of this Resolution shall, for any reason, be declared invalid
by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions
hereof and the Council hereby determines that it would have adopted this Resolution without the
invalid provision.

SECTION 4; That this resolution shall become effective from and after its date of
passage.

Re: Proposal for Engineering Services
Westlake Ground Storage Tank
Dear Jarrod:
Graham Associates, Inc. is pleased to present this proposal for engineering services
associated with the proposed Westlake Ground Storage Tank at the West Pump Staticin.
We propose to provide a complete civil engineering package including surveying,
geotechnical work, construction plans, field inspection and bidding assistance.
Based on our understanding of the project, we propose the following scope of services:
A. Surveying
1. Perform a topographic survey of the tank site for design purposes.
Fee: $2,500
2. Provide construction staking for the project consisting of tank location and
alignment for piping.
Fee: $2,040
R. Geotechnical Report
1. Prepare a geotechnical report of the tank site to be used for design of the concrete
footing. This work will consist of boring three (3) test holes at the site to evaluate
the soils.

and specifications.

These plans will be prepared to provide power to the cathodic protection system.

1. Prepare a tabulation of bids received.
2. Assist in researching the successful bidder.

F. Construction Inspection Services
1. Provide construction inspection services of the following items:
a. concrete footing
b. welding of structural steel
c. protective coating of the tank
Fee: $20,000
Total Fee: $88,685
The above scope of work does not include a tree survey, boundary survey or traffic
control plan.
The above services do not include reimbursable charges such as printing, messenger
services, etc. Reimbursable charges will be billed at direct cost plus 10%.
Billing shall be on a monthly basis for work completed to date with payment due the 15th
of the month following invoice date. Consultant reserves the right to stop work if
payment is not received within 30 days of invoice date until such time as satisfactory
payment arrangements have been made. Ownership of all plans, reports, surveys and
ether related data remain the property of Graham Associates, Inc. until payment for
services has been received.
