Kim Sutter, TRMC, Town Secretary TOWN OF WESTLAKE, TEXAS BOARD OF ALDERMEN MEETING AGENDA FEBRUARY 12, 2007 TOWN HALL - BOARD ROOM 2650 J. T. OTTINGER ROAD 7:00 P.M. 1. CALL TO ORDER. 2. EXECUTIVE SESSION A. The Board will conduct a closed session under Texas Government Code section 551.071 to seek advice of counsel on legal matters involving pending or contemplated litigation, settlement offers, or other legal matters not related directly to litigation or settlement. Pending or contemplated litigation and settlement offers include but are not limited to the following: i. City of Roanoke v. Town of Westlake, Cause No. 02 -01 -00290 -CV (Second Court of Appeals) ii. Town of Westlake v. City of Roanoke (Johnny's Automotive tract), Cause No. 2003-20243-158 (158th Judicial District Court of Denton County, Texas) B. The Board will conduct a closed session under Texas Government Code section 551.074 to discuss personnel matters. C. The Board will conduct a closed session under Texas Government Code section 551.072 to discuss the purchase, exchange, lease, or value of real property. 3. RECONVENE MEETING. 4. EXECUTIVE SESSION ACTION. 5. CITIZENS' PRESENTATIONS: This is an opportunity for citizens to address the Board on any matter whether or not it is posted on the agenda. The Board cannot by law take action nor have any discussion or deliberations on any presentation made to the Board at this time concerning an item not listed on the agenda. Any item presented may be noticed on a future agenda for deliberation or action. 6. CONDUCT A PUBLIC HEARING AND CONSIDER AN ORDINANCE DESIGNATING A REINVESTMENT ZONE #2 ON PROPERTY SOUTH OF S.H. 114 AT WESTLAKE PARKWAY AND PRECINCT LINE ROAD FOR THE PURPOSE OF OFFERING COMMERCIAL -INDUSTRIAL TAX ABATEMENT UNDER CHAPTER 312 OF THE TEXAS TAX CODE. 7. CONSIDER AUTHORIZING MAYOR TO EXECUTE THE U.S. MAYOR'S CLIMATE PROTECTION AGREEMENT. 8. CONSIDER RESOLUTION TO ACCEPT A REPORT REGARDING RACIAL PROFILING STATISTICS AS PREPARED BY CHIEF MARK HAFNER OF THE KELLER POLICE DEPARTMENT IN ACCORDANCE WITH STATE LAW. 9. CONSIDER A RESOLUTION AMENDING THE BUDGET TO CREATE THE SECONDARY WATER SOURCE CAPITAL PROJECT AND PROVIDE FUNDING FOR THE 2006/2007 FY BUDGET. 10. HEAR A STAFF REPORT ON STUCCO EXTERIOR BUILDING MATERIAL. 11. CONSIDER A RESOLUTION APPROVING AMENDMENTS TO THE TOWN OF WESTLAKE PERSONNEL MANUAL. 12. CONSIDER A RESOLUTION APPOINTING MELANIE LEKKOS TO THE TEXAS STUDENT HOUSING AUTHORITY BOARD OF DIRECTORS. 13. CONSENT AGENDA: All items listed below are considered routine by the Board of Aldermen and will be enacted with one motion. There will be no separate discussion of items unless a Board member or citizen so requests, in which event the item will be removed from the general order of business and considered in its normal sequence. A. Review and approve minutes of the Board of Aldermen workshop and the regular Board of Aldermen meeting held on December 11, 2006. B. Review and approve minutes of the Board of Aldermen workshop, the regular Board of Aldermen meeting, and 50th Anniversary Committee Workshop held on January 22, 2007. C. Review and approve any outstanding bills. 14. CONSIDER A RESOLUTION ACCEPTING THE RESIGNATION OF ALDERMEN BUDDY BROWN. 15. CONSIDER AN ORDINANCE CALLING AND ORDERING A GENERAL AND SPECIAL ELECTION, TO BE HELD ON MAY 12, 2007. 16. ADJOURNMENT.
