EXECUTIVE SESSION. A. The Board will conduct a closed session under Texas Government Code section 551.071 to seek advice of counsel on legal matters involving pending or contemplated litigation, settlement offers, or other legal matters not related directly to litigation or settlement. Pending or contemplated litigation and settlement offers include but are not limited to the following: i. City of Roanoke v. Town of Westlake, Cause No. 02 -01 -00290 -CV (Second Court of Appeals) ii. Town of Westlake v. City of Roanoke (Johnny's Automotive tract), Cause No. 2003-20243-158 (158th Judicial District Court of Denton County, Texas) B. The Board will conduct a closed session under Texas Government Code section 551.074 to discuss personnel matters. C. The Board will conduct a closed session under Texas Government Code section 551.072 to discuss the purchase, exchange, lease, or value of real property. 3. RECONVENE INTO OPEN MEETING. 4. EXECUTIVE SESSION ACTION. 5. CITIZENS' PRESENTATIONS: This is an opportunity for citizens to address the Board on any matter whether or not it is posted on the agenda. The Board cannot by law take action nor have any discussion or deliberations on any presentation made to the Board at this time concerning an item not listed on the agenda. Any item presented may be noticed on a future agenda for deliberation or action. 6. CONDUCT A PUBLIC HEARING AND CONSIDER AN ORDINANCE REGARDING AN APPLICATION FOR A SPECIAL USE PERMIT FOR A PRIVATE WATER WELL TO BE LOCATED ON LOT 7 OF THE CARPENTER ADDITION, 5920 MAHOTEA BOONE TRAIL. 7. CONDUCT A PUBLIC HEARING AND CONSIDER AN ORDINANCE REGARDING AN AMENDMENT TO SECTION 102-154 OF THE ZONING ORDINANCE CONCERNING RESIDENTIAL PARKING OF CERTAIN TYPES OF VEHICLES, AMENDING THE ALLOWABLE TIME VEHICLES ARE ALLOWED TO BE PARKED ON RESIDENTIAL LOTS FOR PURPOSES OF LOADING AND UNLOADING AND PROVIDING FOR A MAXIMUM PERIOD IN WHICH THE TRAILER MAY BE USED FOR SLEEPING PURPOSES. 8. CONSIDER AN ORDINANCE AMENDING CHAPTER 50, SECTION 5-2 OF THE WESTLAKE CODE OF ORDINANCES TO REMOVE THE ALLOWANCE FOR FRONT YARD PARKING OF TRAILERS AND RV'S IN ORDER TO BE CONSISTENT WITH SECTION 102-154 OF THE ZONING ORDINANCE. 9. CONSIDER AN ORDINANCE REAPPOINTING THE PRESIDING JUDGE AND ALTERNATE JUDGE FOR THE WESTLAKE MUNICIPAL COURT. 10. CONSIDER A RESOLUTION AMENDING THE FY 05-06 BUDGET AND AUTHORIZING THE TOWN MANAGER TO ESTABLISH A DEPUTY COURT CLERK/WARRANT COLLECTIONS POSITION. 11. CONSIDER A RESOLUTION AUTHORIZING THE TOWN MANAGER TO ESTABLISH AN INCENTIVE PACKAGE FOR THE WARRANT DIVISION OF THE MUNICIPAL COURT. 12. CONSIDER A RESOLUTION AUTHORIZING THE TOWN MANAGER TO NOTIFY VERIZON THAT THE TOWN OF WESTLAKE DOES NOT OBJECT TO VERIZON OPTING OUT OF THE TOWN'S FRANCHISE AND INSTEAD, FALL UNDER THE FRANCHISING AUTHORITY OF THE PUC. 13. CONSIDER AN ORDINANCE ADOPTING THE 2005 NATIONAL ELECTRICAL CODE (NEC 2005). 14. CONSENT AGENDA: All items listed below are considered routine by the Board of Aldermen and will be enacted with one motion. There will be no separate discussion of items unless a Board member or citizen so requests, in which event the item will be removed from the general order of business and considered in its normal sequence. A. Review and approve minutes of the regular meeting held on November 14, 2005. B. Review and approve any outstanding bills. 15. ADJOURNMENT.
