NOTICE OF WORKSHOP AND REGULAR
MEETING
TO THE CITIZENS OF THE TOWN OF WESTLAKE, TEXAS:

Notice is hereby given that the Board of Aldermen of the Town of Westlake, Texas, will meet at
1:00 p.m, on Monday, October 25, 2004, in the administrative conference room of the Town
Hall, located at 2650 J. T. Ottinger Road, Westlake, Texas for a workshop. The Board of
Aldermen will then meet at 7:00 p.m, in the Board room to consider the remainder of the
following agenda:
1. Workshop called to order and announce a quorum.
2. Quarterly financial update.
3. Recess to the regular meeting.
4. Reconvene the meeting in the Board room at 7:00 p.m. (The regular meeting will be held
after the workshop and may begin later than 7:00 p.m.)
5. EXECUTIVE SESSION.
A. The Board will conduct a closed session under Texas Government Code section
551.071 to seek advice of counsel on legal matters involving pending. or
contemplated litigation, settlement offers, or other legal matters not related directly
to litigation or settlement. Pending or contemplated litigation and settlement offers
include but are not limited to the following:
i. City of Roanoke v. Town of Westlake, Cause No. 02 -01 -00290 -CV (Second Court
of Appeals)
ii. Sherry Gray v. Henry Barry, et al., Cause No. 153-18458400 (153rd Judicial
District Court of Tarrant County, Texas)
iii. Gray v. Town of Westlake and Town of Westlake Zoning Board of Adjustment,
Cause No. 02 -02 -00173 -CV (Second Court of Appeals)
iv. Kennel Kare, Inc. and Sherry Gray v. Town of Westlake Zoning Board of
Adjustment, Cause No. 153-194580-02 (District Court of Tarrant County, Texas)
v. Town of Westlake v. City of Roanoke (Johnny's Automotive tract), Cause No.
2003-20243-158 (158th Judicial District Court of Denton County, Texas)
vi. Town of Trophy Club v. Town of Westlake, Cause No. 2004-40094-362 (362nd

Judicial District Court of Denton County, Texas).
vii. Weyerhaeuser Company DIBIA Trus Joist v. Town of Westlake, Manhattan
Construction Company. L.P., and Better Builders -Dallas, Inc., Cause No. 048-
203407-03 (District Court of Tarrant County, Texas).
B. The Board will conduct a closed session under Texas Government Code section
551.072 to discuss the purchase, exchange, lease, or value of real property.
C. The Board will conduct a closed session under Texas Government Code section
551.074 to discuss personnel matters.
D. Reconvene into open meeting.
6. Take necessary action with respect to Item #5 above.
7. Citizens' Presentations: This is an opportunity for citizens to address the Board on any
matter whether or not it is posted on the agenda. The Board cannot by law take action nor
have any discussion or deliberations on any presentation made to the Board at this time
concerning an item not listed on the agenda. Any item presented may be noticed on a
future agenda for deliberation or action.
8. Consider a Resolution appointing Dr. Larry Darlage as a member of the Board of Directors
of each of the Texas Student Housing Corporation, the Texas Student Housing Authority,
the Texas Student Housing Corporation - San Marcos Project, the Texas Student Housing
Corporation - Denton Project, the Texas Student Housing Corporation - College Station
Project, the Texas Student Housing Corporation - MSU Project, the Texas Charter School
Corporation - LTTS Charter School, Inc. Project, and the Texas Charter School
Corporation - New Frontiers Charter School Project.
9. Consider a Resolution appointing a member to the Board of Directors of the Westlake
Academy Foundation.
10. Consider a Resolution adopting a Personnel Manual.
11. Consent Agenda: All items listed below are considered routine by the Board of Aldermen
and will be enacted with one motion, There will be no separate discussion of items unless
a Board member or citizen so requests, in which event the item will be removed from the
general order of business and considered in its normal sequence.
A. Review and approve minutes of the workshop and regular meeting held on October 11,
2004,
B. Review and approve any outstanding bills.

The Board of Aldermen may at any time convene into executive session as authorized by
Chapter 551 of the Texas Government Code to discuss any item posted on the agenda.
