HomeMy WebLinkAbout04-26-04 TC AgendaNotice of Board of Aldermen i ting Page 1 of 2 TOWN OF WESTLAKE, TEXAS NOTICE OF REGULAR MEETING AND WORKSHOPW IE� �$ TO THE CITIZENS OF THE TOWN OF WESTLAKE, TEXAS: Notice is hereby given that the Board of Aldermen of the Town of Westlake, Texas, will meet at 3:00 p.m. on Monday, April 26, 2004, in the Boardroom of the Town Hall, located at 2650 J.T. Ottinger Road, in the Town of Westlake, Texas for a workshop. The Board of Aldermen will then meet at 7:00 p.m, to consider the following agenda: 1. Workshop called to order and announce a quorum. 2. Discuss Thoroughfare Plan, Open Space Plan, Water Plan and Wastewater Plan. 3. Adjourn to the regular meeting. 4. Call the regular meeting to order at 7:00 p.m. and announce a quorum. (The regular meeting will be held after the workshop and may begin later than 7:00 p.m.) 5. EXECUTIVE SESSION. A. The Board will conduct a closed session under Texas Government Code section 551.071 to seek advice of counsel on legal matters involving pending or contemplated litigation, settlement offers, or other legal matters not related directly to litigation or settlement. Pending or contemplated litigation and settlement offers include but are not limited to the following: i. City of Roanoke v. Town of Westlake, Cause No. 02 -01 -00290 -CV (Second Court of Appeals) ii. Sherry Gray v. Henry Barry, et al., Cause No. 153-18458400 (153rd Judicial District Court of Tarrant County, Texas) iii. Gray v. Town of Westlake and Town of Westlake Zoning Board ofAdjustment, Cause No. 02 -02 -00173 -CV (Second Court of Appeals) iv. Kennel Kare, Inc. and Sherry Gray v. Town of Westlake Zoning Board ofAdjustment, Cause No. 153-194580-02 (District Court of Tarrant County, Texas) v. Town of Westlake v. City of Roanoke (Johnny's Automotive tract), Cause No. 2003- 20243-158 (158th Judicial District Court of Denton County, Texas) vi. Weyerhaeuser Company DIBIA Trus Joist v. Town of Westlake, Manhattan Construction Company, L.P., and Better Builders -Dallas, .Inc., Cause No 048-20340 7-03 (District Court of Tarrant Count, Texas) vii. The Board will conduct a closed session under Texas Government Code section 551.074 to discuss personnel matters. C. Reconvene into open meeting. 6. Take necessary action with respect to Item 45 above. 7. Citizens' Presentations: This is an opportunity for citizens to address the Board on any matter whether or not it is posted on the agenda. The Board cannot by law take action nor have any discussion or deliberations on any presentation made to the Board at this time concerning an item not listed on the agenda. Any item presented may be noticed on a future agenda for deliberation or action. 8. Consider a Resolution authorizing the Town Manager to enter into a Ground and Tower Lease Agreement with BelWave Communications. 9. Hear a presentation by Jim Carter, Denton County Commissioner, regarding the roads that have been selected for the Bond program. 10. Consent Agenda: All items listed below are considered routine by the Board of Aldermen and will be enacted with one motion. There will be no separate discussion of items unless a Board member or citizen so requests, in which event the item will be removed from the general order of business and considered in its normal sequence. A. Review and approve minutes of the regular meeting held on April 12, 2004. B. Review and approve any outstanding bills. 11. Adjournment. Ottinger Road, Westlake, Texas, on Friday, April 23, 2004, at 5:00 p.m., under the Open Meetings Act, Chapter 551 of the Texas Government Code.
