TOWN OF WESTLAKE, TEXAS
NOTICE OF REGULAR MEETING STILE
TO THE CITIZENS OF THE TOWN OF WESTLAKE, TEXAS:
Notice is hereby given that the Board of Aldermen of the Town of Westlake, Texas, will meet at 7:00
p.m. on Monday, February 9, 2004, in the Boardroom of the Town Hall, located at 2650 J.T. Ottinger
Road, in the Town of Westlake, Texas. The Board will consider the following agenda:
1. Meeting called to order and announce a quorum.
2. EXECUTIVE SESSION.
A. The Board will conduct a closed session under Texas Government Code section 551.071 to
seek advice of counsel on legal matters involving pending or contemplated litigation,
settlement offers, or other legal matters not related directly to litigation or settlement.
Pending or contemplated litigation and settlement offers include but are not limited to the
following:
i. City of Roanoke v. Town of Westlake, Cause No. 02 -01 -00290 -CV (Second Court of
Appeals)
ii. Sherry Gray v. Henry Barry, et al., Cause No. 153-18458400 (153rd Judicial District
Court of Tarrant County, Texas)
iii. Gray v. Town of Westlake and Town of Westlake Zoning Board ofAdjustment, Cause
No. 02 -02 -00173 -CV (Second Court of Appeals)
iv. Kennel Kare, Inc. and Sherry Gray v. Town of Westlake Zoning Board ofAdjustment,
Cause No. 153-194580-02 (District Court of Tarrant County, Texas)
v. Boundary issue with Town of Trophy Club.
vi. Town of Westlake v. City of Roanoke (Johnny's Automotive tract), Cause No. 2003-
20243-158 (158th Judicial District Court of Denton County, Texas)
vii. Weyerhaeuser Company DIBIA Trus Joist v. Town of Westlake, Manhattan Construction
Company, L.P., and Better Builders -Dallas, Inc., Cause No 048-20340 7-03 (District Court
of Tarrant Count, Texas)
B. The Board will conduct a closed session under Texas Government Code section 551.072 to
deliberate the purchase, exchange, lease or value of real properly, specifically the pending
purchase of a 6.52 -acre tract of land located at the intersection of US 377 and SH 170.
C. Reconvene into open meeting.
3. Take necessary action with respect to Item 42 above.

4. Citizens' Presentations: This is an opportunity for citizens to address the Board on any matter
whether or not itis posted on the agenda. The Board cannot by law take action nor have any
discussion or deliberations on any presentation made to the Board at this time concerning an item
not listed on the agenda. Any item presented may be noticed on a future agenda for deliberation or
action.
5. Consider a Resolution appointing two members to the Board of Directors of the Texas Student
Housing Entities,
6. Consider a Resolution amending the FY 03-04 budget to fund a new landscape entry feature for
the intersection of Randol Mill and Dove Road in conjunction with the G1enWyck Farms
residents.
7. Consider a Resolution to amend the FY 2003104 budget to increase fimding for janitorial services
to be provided at the Municipal Complex.
8. Consider a Resolution adopting a Flex 125 Plan for the Town employees.
9. Consider a Resolution authorizing the Town Manager to enter into a contract with Stw, Inc. for
the purchase of a utility billing software system.
10. Consider a Resolution authorizing the Town Manager to enter into a contract with DataProse
Billing Solutions.
11. Consider a Resolution authorizing the purchase of Badger automated water meter reading
software and equipment.
12. Consider a Resolution authorizing the Town Manager to enter into a contract with Hadden
Landscaping for landscape services to be provided at the Minicipal Complex, Pump Station and
GlenWyck Farms open space.
13. Consider an Ordinance calling an election to be held on the 15th day of May, 2004, for the
purpose of electing a Mayor and two Aldermen to two-year terms.
14. Consider an Ordinance amending Ordinance No. 406 to amend the Water Tap fees.
15. Consider a Resolution regarding the state's right of way on old U.S. Hwy. 377.
16. Consent Agenda: All items listed below are considered routine by the Board of Aldermen and will
be enacted with one motion. There will be no separate discussion of items unless a Board member
or citizen so requests, in which event the item will be removed from the general order of business
and considered in its normal sequence.
A. Review and approve minutes of the regular meeting held on January 26, 2003.
B. Review and approve any outstanding bills.
C. Consider a Resolution approving certain contracts relating to the Westlake Civic Campus.
