HomeMy WebLinkAboutOrd 776 Approving an Specific Use Permit for the Entrada Amphitheater TOWN OF WESTLAKE ORDINANCE NO. 776 AN ORDINANCE OF THE TOWN OF WESTLAKE APPROVING A SPECIFIC USE PERMIT TO ALLOW AN AMPHITHEATER WITH AN OCCUPANCY OF GRATER THAN (300) THREE-HUNDRED, BUT NOT GREATER THAN (3,000), TO BE CONSTRUCTED AT 64 TARRAGONA WITHIN THE WESTLAKE ENTRADA DEVELOPMENT IN THE PD 1 ZONING DISTRICT, PLANNING AREA 2, (PD 1-2). PROVIDING A PENALTY; PROVIDING A CUMULATIVE CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AUTHORIZING PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS,the Town of Westlake,Texas is a general law Town; and WHEREAS, the Town Council of the Town of Westlake has determined that this request is in conformance with the approved Concept Plan and approved PD Site Plan to allow, under certain conditions,events with greater than(300)expected attendance to be held at the amphitheater to be located at 64 Tarragona within the PD 1-2 zoning district; and WHEREAS, upon the recommendation of the Planning and Zoning Commission the Town Council of the Town of Westlake, Texas, has determined that it is in the best interests of the town and its citizens,that the Special Use Permit should be approved and adopted. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE,TEXAS: SECTION 1: That all matters stated in the preamble are found to be true and correct and are incorporated herein as if copied in their entirety. SECTION 2. That the Specific Use Permit for occupancy of greater than 300 but not to exceed 3,000 occupancy is approved with the following conditions: 1. For any event held in the Amphitheater that is anticipated to have greater than 300 people, the Amphitheater operator must provide a pre-event submittal for each event for over 300 people that demonstrates to the Town that adequate provisions have been made to accommodate anticipated needs for: a. ap rking (which may involve shared parking agreements with neighboring property owners); b. traffic control (which may include a traffic impact analysis, to be updated as needed or for each event); e. securi (including a plan setting out how many emergency service personnel will be needed); d. noise(requiring compliance with Town ordinances in regard to sound levels and hours of operation); e. meeting the requirements of the mass gathering ordinance (including insurance and indemnity); and f. any other concerns in regard to public health safety or welfare, (which could include type of show, for example, shows with pyrotechnics will require greater protections, or meteorological conditions,or multiple events occurring simultaneously). Ordinance 776 Page 1 of 2 2. The pre-event submittal may be administratively approved by the Town Manager or designee, subject to appeal to Town Council for denial. SECTION 3: That this Ordinance shall be cumulative of all other Town Ordinances and all other provisions of other Ordinances adopted by the Town which are inconsistent with the terms or provisions of this Ordinance are hereby repealed. SECTION 4: That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Code of Ordinances of the Town of Westlake, and upon conviction shall be punishable by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 5: It is hereby declared to be the intention of the Town Council of the Town of Westlake,Texas,that sections, paragraphs, clauses and phrases of this Ordinance are severable,and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared legally invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such legal invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the same would have been enacted by the Town Council of the Town of Westlake without the incorporation in this Ordinance of any such legally invalid or unconstitutional,phrase,sentence,paragraph or section. SECTION 6: This ordinance shall take effect immediately from and after its passage as the law in such case provides. PASSED AND APPROVED ON THIS 28`h DAY OF MARCH 2016.
