HomeMy WebLinkAbout01-27-97 Impact Advisory Comm MinTOWN OF WESTLAKE MINUTES OF THE IMPACT FEE ADVISORY COMMITTEE MEETING JANUARY 27,1997 Present: Abe Bush, Jr., Member Darcy Anderson, Member Steve Sallman, Member Richard Kulhman, Member Terry Morgan, Town Legal Advisor Dennis Wilson, Town Planner Eddie Haas, Town Traffic Consultant Larry Fuson, Town Engineering Consultant Ginger Crosswy, Town Secretary Also Present: Timothy Green, Attorney for Lake Turner MUDS 1, 2 & 3 Bill Resch, Alliance Development Company Absent: Bill Greenwood, Chairman Charla Bradshaw, Member Dale White, Member The meeting was called to order at 4:10 p.m. by Dennis Wilson. Eddie Haas of Barton-Aschman answered questions concerning the Roadway CIP that were asked in a letter from Richard Kuhlman of Maguire -Thomas Partners on December 24, 1996. There was a lengthy discussion concerning the fact that Kirkwood Boulevard is an existing roadway paid for by Maguire -Thomas Partners and issuing credit to Maguire - Thomas Partners for the extra capacity that was built into this roadway. Larry Fuson of The Hogan Corporation explained some additional figures to the Committee. These figures show the difference in the impact fee imposed if existing residences are asked to pay to hook up to the water/wastewater facilities that would be put into place in the Town in the future. Darcy Anderson of Alliance Development Company asked if Trophy Club MUD No. 1 existing facilities that service the Solana development are included in the CIP? Upon being told that they are not included, Mr. Anderson then asked why the Lake Turner MUDS 1, 2 & 3 are included? Terry Morgan, the Town's Legal Advisor, stated that the Town is assuming that the Town will eventually control Lake Turner MUDS 1, 2 & 3. After a lengthy discussion between Tim Green of Coats, Rose, Yale, Holm, Ryman & Lee, representing Lake Turner Municipal Utility Districts 1, 2 & 3, and Mr. Morgan as to whether the existing facilities and the future facilities incorporated in the MUDS should be included in the water/wastewater CIP there was much discussion by the Committee on the same subject. Mr. Anderson stated that he could not support any recommendation that included the MUDs in the CIP. A motion was made by Steve Sallman that the recommendation to the Board be to approve the water/ wastewater CIP as presented by The Hogan Corporation Impact Fee Advisory Committee Meeting January 27, 1997 Page 2 with the exception that any existing facilities in every MUD within the Town's boundaries and any planned facilities be excluded from the CIP, with the addition of the agreed upon cost that the Town would assume in the event that the Town supplies the utilities to the area included in the Lake Turner MUD's 1, 2 & 3. After much discussion, this motion died for lack of a second. Mr. Sallman then made a motion that the recommendation be given to the Board that the water/wastewater CIP be adopted as prepared by The Hogan Corporation with the following facilities and costs to be excluded; any existing or planned capital improvements within the territory of a municipal utility district (MUD) within the Town of Westlake. The Committee further recommends, however, that if the MUDs and the Town reach agreement that any capital improvements within the territory of a MUD are to be financed by the Town, such improvements should be restored to the list. The Committee further recommends that the Town delay its decision on the adoption of impact fees until a reasonable time after scheduled mediation between the Town, the developers and the MUDS to determine the nature of the improvements to be included in the CIP if agreement is reached. This motion passed 3 to 1. A motion was made by Richard Kuhlman, seconded by Darcy Anderson, to recommend to the Board that the Board not adopt the roadway CIP as presented by Barton-Aschman. After much discussion by the Committee Mr. Kuhlman withdrew his motion. Abe Bush, Jr. then made a motion to recommend to the Board that the roadway CIP be adopted as presented by Barton-Aschman, with the further recommendation that any developer who has installed facilities providing excess capacity to the service district receive credit for such facilities against impact fees due, whether or not the facilities are included on the CIP. This motion passed 3 to 1. The meeting was adjourned at 7:23 p.m.
