HomeMy WebLinkAbout03-16-04 ZBA MinTOWN OF WESTLAKE, TEXAS MINUTES OF THE MEETING OF THE ZONING BOARD OF ADJUSTMENT March 16, 2004 Present: Larry Sparrow, Vice Chairman Buddy Brown, Member Bill Frey, Member Fred Held, Member Trent Petty, Town Manager Michael Kailas, Assistant Town Attorney Ginger Crosswy, Town Secretary Absent: Don Redding, Chairman Page 1 of 2 west ake, -ryas Item #1:Vice Chairman Sparrow called the meeting to order at 7:03 pm. by announcing a quorum, consisting of Mr. Brown, Mr. Frey, Mr. Held and himself. Item 42: Review and approve the minutes of the meetings held on November 25, 2002. There was a motion by Mr. Frey, seconded by Mr. Brown, to approve the minutes as presented. There was no discussion and the motion carried unanimously. Item #3: Consider and take any appropriate action regarding an application filed by Castlegate Homes requesting a side yard setback variance for a home being built at 2006 Navasota Cove in Vaquero. Mr. Petty spoke explaining this house is 90% finished and was built according to information from the developer that was not consistent with the Town's requirements. Mr. Tom Pritchett of 3017 Westminster Drive in Farmers Branch spoke representing the applicant. Mr. Kailas told the Board to grant a variance they must determine that a denial would create a hardship. After a short discussion of this item there was a motion by Mr. Brown, seconded by Mr. Held, that the evidence presented shows that a hardship exists and the variance requested by granted. There was no further discussion and the motion carried unanimously. Item #4: Consider and take any appropriate action regarding an application filed by Castlegate Homes requesting a side yard setback variance for a home to be built at 2004 White Wing Cove in Vaquero. Mr. Pritchett asked if he could address this item and the next one together. He told the Board the same applicant owns both Mr. Petty lots and the requests to build over the required set backs would be on the side facing the other lot and the builder would increase the amount of landscaping by placing several trees on each side of the property line between these tow lots. He stated the hardship exists due to the fact that both houses have already been designed at a large cost to the builder. Aaron Van Pran was in attendance representing the developer and told the Board these three houses would be the only houses already under construction or designed that would be affected by the incorrect information. After a short question and answer session there was a motion by Mr. Frey, seconded by Mr. Brown, that due to the evidence presented the Board finds that special conditions cause a hardship to exist and the variance be granted. There was no further discussion and the motion carried unanimously. Item 45: Consider and take any appropriate action regarding an application filed by Castlegate Homes requesting a side yard setback variance for a home being built at 2002 White Wing Cove in. Vaquero. There was a motion by Mr. Held, seconded by Mr. Frey, that due to the evidence presented the Board finds that special conditions cause a hardship to exist and the variance requested by granted.
