4. CONSIDER AN APPLICA'T'ION AND TAKE APPROPRIATE ACTION
REGARDING AN AMENDED CONCEPT PLAN, BEING A 311-AC TRACT OF
LAND GENERALLY LOCATED IN DENTON AND TART TT COUNTIES,
TEXAS (i) SOUTH OF S.II.114, (ii) WEST OF PRECINCT LINER AD, AND (iii)
NORTH OF DOVE ROAD, DESCRIBED AS PLANNED DEVELOPMENT 2 AND
KNOWN AS FIDELITY.

Conduct a Public Hearing and take appropriate action regarding an application for a
specific use permit and amended site plan for a helistop to be located at 3 Campus Circle
in the Solana Business Park; described as the Westlake /Southlake Park Addition No. 1;
Lot 1, Block 1; at the NW corner of Solana Boulevard and SH 114.
RECOMMENDATIONS
Staff recommends approval.
BACKGROUND
Solana is a unique property in Westlake in that it was the first PD zoned in the entire
town. As such, many of the straight zoning codes on the books today were taken from the
standards developed for Solana. Solana is in PD 1, which outlines the same criteria as the
Town's Office Park Zoning. Within the Office Park criteria is a provision for
"Helistops ", which in the context of Solana's request is the same as a Helipad. The
original Solana PD made no mention of helipads or helistops, so we can only presume
that the right to build the helipad already on site was administratively allowed, was
granted because of the SUP allowance in the office use, or was never requested by the
applicant. Regardless, that pad has been in operation for many years. This request
formalizes the process in accordance with the current zoning ordinance and requests an
SUP for construction of a helistop /helipad north of the First American complex as
indicated on the attached site plan. Utilization of the new pad will reduce the reliance on
the pad south of the health club which is much closer to residential use; so in order to
reduce the impact of current operations on these uses, staff recommends approval of the
new site. The site meets all FAA required guidelines.

WHEREAS, the Board of Aldermen of the Town of Westlake amended the Town of
Westlake Code of Ordinance on November 20, 1985 by adopting PD -1 and establishing
the zoning necessary to accommodate the Solana office complex; and
WHEREAS, the Board of Aldermen find it in the best interest of the public to amend the
Solana Comprehensive Site Plan to accommodate a helipad on the northern portion of
PD -1 adjacent to the newly established First American Regional Headquarters in order to
enhance the economic viability and customer convenience of the Solana complex and
reduce noise produced from existing helicopter operations south of the Solana Health
Club; and
WHEREAS, the current zoning of the Solana PD -1 reflects the base zoning standard of
the O- Office Park zoning criteria which allows helistop as a specific use.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE TOWN OF
SECTION 1: That all matters stated in the preamble are found to be true and correct and
are incorporated herein as if copied in their entirety.
SECTION 2: That the Board of Aldermen of the Town of Westlake, Texas, does hereby
approve a specific use permit for a helistop facility and amended comprehensive site plan
attached hereto as Exhibit A reflecting the location of the a new helistop in PD -l.
SECTION 3: It is hereby declared to be the intention of the Board of Aldermen of the
Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this
Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this
Ordinance shall be declared legally invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such legal invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of
this Ordinance since the same would have been enacted by the Board of Aldermen of the
Town of Westlake without the incorporation in this Ordinance of any such legally invalid
or unconstitutional, phrase, sentence, paragraph or section.

WESTLAKE, TEXAS, THIS DAY OF , 2007.
