Consider and take appropriate action regarding an application for a final plat being 54.77
acres, described as the follows: 1) Charles M Throop, , A 1510, Tr 7A2 & Tr 7A5 being
approximately 13.72 acres of land at 1280 Dove Road; 2) Charles M Throop, A 1510, Tr
1B03 being approximately .94 acres of land at 2650 Sam School Road; 3) TW Mann, A
1107, Tr 1B3 & A 1510, Tr 1B1 being approximately 2.35 acres of land at 2698 Sam
School Road; and 4) Charles M Throop, A 1510, Tr 7A01 AND Tr 7AOlA being
approximately 37.31 acres of land at 1400 & 1440 Dove Road; and as described in deeds
filed in the County Clerks File No. D207266540, D207266541, D207266542 AND
D207266543, of the Deed Records of Tarrant County, Texas.
BACKGROUND
Terra Bella is a development proposed by Paul Spain for which the P &Z Commission
and Board of Aldermen approved a zoning change request to a planned development and
preliminary plat. Now, a final plat has been submitted for the Commission's
consideration and the plat is attached for your review.
The final plat has been reviewed by staff and it does conform with the approved
preliminary plat and the requirements of the Westlake Uniform Development Code. Staff
recommends approval of the final plat subject to the following condition:
26' wide private strer,,.s to be approved rather than 30' streets as required in the
UDC.

PRESENT: Chairman Bill Greenwood, Commissioners Tim Brittan, Allen Heath, and Sharon
Sanden.
ABSENT: Commissioner Copeland
OTHERS PRESENT: Town Manager Trent Petty, Town Attorney Stan Lowry, Town
Secretary Kim Sutter, and DPS Director Don Wilson.
1. CALL TO ORDER.
Chairman Greenwood called the meeting to order at 6:18 p.m.
2. REVIEW AND APPROVE MINUTES OF THE PLANNING AND ZONING
COMMISSION MEETING HELD ON AUGUST 23, 2007.
Chairman Greenwood introduced the item and asked for a motion.
MOTION: Commissioner Heath made a motion to approve the minutes as presented.
Commissioner Sanden seconded the motion. The motion carried by a vote of
4 -0.
3. CONDUCT A PUBLIC HEARING AND CONSIDER AN APPLICATION
AMENDING THE COMPREHENSIVE ZONING ORDINANCE BY RATIFYING,
CONFIRMING, AND READOPTING PLANNED DEVELOPMENT DISTRICT NO.
3 -9 CONSISTING OF APPROXIMATELY A 48.293 ACRE TRACT OF LAND
SITUATED IN THE M.E.P. & P.R.R.CO. SURVEY, ABSTRACT NO. 923 AND J.
BACON SURVEY, ABSTRACT NO. 1565; GENERALLY LOCATED NORTHWEST
OF STATE HIGHWAY 170 AT ITS INTERSECTION WITH OTTINGER ROAD.

Town Manager Petty advised the Commission that items 3 and 4 are a result of the boundary
settlement agreement with the City of Roanoke. Mr. Petty added that the zoning on these
properties has not changed and that action on these items is required to satisfy the steps
outlined in the settlement agreement.
Chairman Greenwood opened the public hearing.
There being no one requesting to speak, Chairman Greenwood asked for a motion to close
the public hearing.
MOTION: Commissioner Heath made a motion to close the public hearing.
Commissioner Brittan seconded the motion. The motion carried by a vote of
4 -0.
MOTION: Commissioner Sanden made a motion to recommend approval of the item as
presented. Commissioner Heath seconded the motion. The motion carried
by a vote of 4 -0.
4. CONDUCT A PUBLIC HEARING AND CONSIDER AN APPLICATION
AMENDING THE COMPREHENSIVE ZONING ORDINANCE BY RATIFYING,
CONFIRMING, AND READOPTING PLANNED DEVELOPMENT DISTRICT NO.
3 -5A CONSISTING OF APPROXIMATELY A 1.314 ACRE TRACT OF LAND
SITUATED IN THE M.E.P. & P.R.R.CO. SURVEY, ABSTRACT NO. 923 AND J.
BACON SURVEY ABSTRACT NO. 1565; GENERALLY LOCATED AT THE
CORNER OF OTTINGER ROAD AND STATE HIGHWAY 170.
Chairman Greenwood introduced the item and opened the public hearing.
There being no one requesting to speak, Chairman Greenwood asked for a motion to close
the public hearing.
MOTION: Commissioner Brittan made a motion to close the public hearing.
Commissioner Sanden seconded the motion. The motion carried by a vote of
4 -0.
MOTION: Commissioner Brittan made a motion to recommend approval of the item as
presented. Commissioner Heath seconded the motion. The motion carried
by a vote of 4 -0.

5. CONDUCT A PUBLIC HEARING AND TAKE APPROPRIATE ACTION
REGARDING AN APPLICATION FOR A SPECIFIC USE PERMIT FOR OIL AND
GAS SEISMIC TESTING TO BE PERFORMED IN THE PLANNED
DEVELOPMENT 1, OWNED BY MAGUIRE PARTNERS- SOLANA LP, IN THE
WESTLAKE /SOUTHLAKE ADDITION NO. 1; ON APPROXIMATELY 450 ACRES
OF LAND OUT OF THE C.M. THROOP SURVEY, ABSTRACT NO. 1510, THE W.
MEDLIN SURVEY, ABSTRACT NO. 1958, THE U.P. MARTIN SURVEY,
ABSTRACT NO. 1015, THE J. B. MARTIN SURVEY, ABSTRACT NO. 1134 AND
THE T. W. MANN SURVEY, ABSTRACT NO. 1107, DENTON AND TARRANT
COUNTIES, TEXAS.
Town Manager Petty introduced item and advised the Commission that approval of this item
would authorize seismic testing only on Maguire Partners property.
Commissioner Heath suggested the Town review the current oil and gas well drilling
ordinance.
Town Manager Petty advised that the Town is reviewing the ordinance and will bring
recommendations to the Board of Aldermen for discussion.
Chairman Greenwood asked.what, if any level of noise is expected with this type of testing.
Commissioner Brittan advised that the noise is nominal.
Commission Heath asked for clarification on the diagram presented.
Mr. David Viscarde, Time Slice Technology, Inc., offered an explanation regarding the
diagram, and advised that the process would take approximately 3 -5 days.
Chairman Greenwood opened the public hearing.
There being no one requesting to speak, Chairman Greenwood asked for a motion to close
the public hearing.
MOTION: Commissioner Brittan made a motion to close the public hearing.
Commissioner Heath seconded the motion. The motion carried by a vote of
4 -0.
MOTION: Commissioner Heath made a motion to recommend approval of the
application for a specific use permit for seismic testing to be performed in the
Planned Development 1 by Maguire Partners. Commissioner Brittan
seconded the motion. The motion carried by a vote of 4 -0.

6. CONDUCT A PUBLIC HEARING AND TAKE APPROPRIATE ACTION
REGARDING AN APPLICATION FOR A SPECIFIC USE PERMIT FOR A
PRIVATE WATER WELL TO BE LOCATED ON 2252 KING FISHER DRIVE;
VAQUERO PHASE 2; LOT 1, BLK B. -
Chairman Greenwood introduced the item.
Town Manager Petty advised the Commission that the request has met the Town's
requirements.
Chairman Greenwood opened the public hearing.
There being no on requesting to speak, Chairman Greenwood asked for a motion to close the
public hearing.
MOTION: Commissioner Brittan made a motion to close the public hearing.
Commissioner Sanden seconded the motion. The motion carried by a vote of
4 -0.
MOTION: Commissioner Sanden made a motion to recommend approval of the
application for a specific use permit. Commissioner Heath seconded the
motion. The motion carried by a vote of 4 -0.
7. CONSIDER AND TAKE APPROPRIATE ACTION REGARDING AN
APPLICATION FOR A PRELIMINARY PLAT BEING APPROXIMATELY 3.648
ACRES OF LAND AT 1475 DOVE ROAD; DESCRIBED AS THE STANTON
ADDITION; C.M. THROOP SURVEY, ABSTRACT NO. 1510, TRACT 5A & 5A01A,
TARRANT COUNTY, TEXAS.
Chairman Greenwood introduced the item.
Town Manager Petty advised the Commission that the case plats three lots on Dove Road,
and each lot meets the R -1 zoning standard of 43,560 square feet.
Commission Heath asked for clarification regarding the flood way dedication.
Town Manager Petty replied that the flood way dedication is in compliance with the Town's
ordinance.
Chairman Greenwood opened the public hearing.
There being no one requesting to speak, Chairman Greenwood asked for a motion to close
the public hearing.
MOTION: Commissioner Brittan made a motion to close the public hearing.
Commissioner Sanden seconded the motion. The motion carried by a vote of
4 -0.

application for a preliminary plat. Commissioner Brittan seconded the
motion. The motion carried by a vote of 4 -0.
8. ADJOURNMENT.
There being no further business to come before the Commission, Chairman Greenwood
asked for a motion to adjourn the meeting.
MOTION: Commissioner Heath made a motion to adjourn the meeting. Commissioner
Brittan seconded the motion. The motion carried by a vote of 4 -0.
Chairman Greenwood adjourned the meeting at 6:37 p.m.
