MINUTES OF THE TOWN OF WESTLAKE, TEXAS PLANNING AND ZONING COMMISSION MEETING October 25, 2007 PRESENT: Chairman Bill Greenwood, Commissioners Tim Brittan, Walter Copeland, Allen Heath, and Sharon Sanden. ABSENT: None. OTHERS PRESENT: Town Manager Trent Petty, Town Secretary Kim Sutter, and DPS Director Don Wilson. 1. CALL TO ORDER. Chairman Greenwood called the meeting to order at 7:06 p.m. 2. REVIEW AND APPROVE MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON SEPTEMBER 24, 2007. Chairman Greenwood introduced the item and asked for a motion. MOTION: Commissioner Brittan made a motion to approve the minutes as presented. Commissioner Sanden seconded the motion. The motion carried by a vote of 5 -0. 3. Mr. Petty advised that staff has worked to ensure that the floodplain is protected and the trial plan is extended. Mr. Petty noted that the applicant is requesting 26 foot wide streets as opposed to the UDC recommended 30 foot wide streets. Additionally, Mr. Petty stated that the plat has been reviewed by the Town Engineer and does meet the Town's requirements, and staff is recommending approval. Mr. Richard DeOtte, DeOtte, Inc., and Mr. Bobby Harrell, Partner, Terra Land Management, Inc., was present to address questions of the Commission. Mr. Richard DeOtte advised the Commission that the homeowners association will be responsible for the maintenance of the gates in and out of the community, and the gates will be closed from dusk to dawn. Commissioner Heath inquired if the hours for opening and closing the gates as well as the trail layout should be included on the final plat, and if the trail must be wide enough to accommodate emergency vehicles. Town Manager Petty recommended the Town's UDC be amended to include the gate hours. Mr. Petty advised that that staff will stake the trail for placement during construction of the public streets and that the trial can be located anywhere in the floodplain and will be included on the site plan. Mr. Petty added that the trail will be six to eight feet wide. Discussion ensued with regard to the size and height of the gates, and a secondary entrance for emergency vehicles. MOTION: Commissioner Copeland made a motion to recommend approval of the final plat with 26 foot wide private streets. Commissioner Heath seconded the motion. The motion carried by a vote of 5 -0. 4. ADJOURNMENT. There being no further business to come before the Commission, Chairman Greenwood asked for a motion to adjourn the meeting. MOTION: Commissioner Brittan made a motion to adjourn the meeting. Commissioner Copeland seconded the motion. The motion carried by a vote of 5 -0. Throop Survey, Abstract No. 1510, Tract 5A & 5AOIA, Tarrant County, Texas. BACKGROUND The Stanton Addition is a proposed subdivision by Mike Stanton located on Dove Road. The Commission approved the preliminary plat on September 24, 2007, which consists of four (4) lots. Lot 1 has an existing home on it along with an accessory building. Lots 2 and 3 are one (1) acre in size that conforms to the R -1 zoning of the property. Lot 4 consists of floodway and is being dedicated to the Town. We will be presenting both the Preliminary Plat and the Final Plat (if approved) to the Board of Aldermen for final approval on December 10, 2007. The Preliminary Plat was initially presented to the Board of Aldermen for final approval on September 24, 2007, but they tabled until further clarification could be made concerning the floodplain in Lot 3 and the actual lot size with or without the floodplain within this lot. The plat has been reviewed by staff and the surveyor has addressed our initial comments. The final plat conforms to the requirements of the Uniform Development Code and staff recommends that it be approved. DM — has been discussed with owner and will take care of prior to final filing of the plat. Flood way and flood plain — code reads fw dedicated to the Town. Explained fw and fp. Lot 4 part of fw reserved for flood water. Area dedicated in lot 4 required dedication per code. Plat does comply with our code. JH — control mechanism to control bldg in floodplain in the future. DM — permit would be rqd. JH — has wl allowed structure in fp? DM — not to his knowledge. Jh — never required fp, but not fw? Dm — only exception would be with pds. TB — does city have liability if damage to wall in fp? MC — whoever puts in up takes the liability. may not be development in fp. Should not have to encroach in fp — plenty of pad to build. Town of Westlake RE: Final Plat Stanton Addition DATE: November 16, 2007 The Town of Westlake staff has reviewed the Final Plat submittal for the Stanton Addition. The following staff comments on the plat must be addressed prior to being scheduled for the Planning and Zoning Commission. 1. Your surveyor's seal must be added to the surveyor's certificate. 2. There are some discrepancies between the legal description and the drawing. The call for L4 is missing from the legal description. 3. Monuments must be set on two (2) corners of the subdivision that are tied to the Town GPS monuments and the coordinates shown on the plat. 4. Add a Certificate of Approval for the Planning and Zoning Commission. 5. Lot 3 must have a minimum finished floor elevation indicated. 6. Remove the existing overhead electrical line across Lot 3 from the plat. If the utility company requires an easement can be dedicated by this plat. The electrical line must be buried or removed prior to filing of the plat. 7. Provide a printout of the boundary closure calculation. Please address these comments and resubmit the plat so that a P &Z Commission meeting can be scheduled for the first week in December.
