NOTICE OF MEETING
TO THE CITIZENS OF THE TOWN OF WESTLAKE, TEXAS:
Notice is hereby given that the Zoning Board of Adjustment of the Town of Westlake, Texas, will meet
at 6:30 p.m. on Monday, September 27,2004, in the Boardroom located at 2650 J.T. Ottinger Road, in
the Town of Westlake, Texas. The Board will consider the following agenda:
1. Meeting called to order and announce a quorum.
2. Review and approve minutes of the meeting held on August 9, 2004.
3. Conduct a Public Hearing and take any appropriate action regarding an application filed by the
Town to extend a variance to the time restrictions on a temporary structure for the Westlake Fire
and Rescue.
4. Adj ournment.

Absent: No one.
Item#1: Chairman Redding called the meeting to order at 6:17 p.m.
Item#2: There was a motion by Mr. Sparrow, seconded by Mr. Held,to approve the
minutes of the meeting held on March 16, 2004 as presented. There was no discussion
and the motion carried unanimously.
Item#3: Conduct a Public Hearing and take any appropriate action regarding an
application filed by Diego's Restaurant requesting a variance to the Town's sign
standards. Mr. Petty explained to the Board that the sign Diego's Restaurant wants to
erect would violate the Town's sign standards in three ways: (1)the height of the letters,
(2)the total square footage of the sign and(3) illumination. Mr. Tom Allen, a partner
with Maquire Partners, was in attendance representing the applicant and answered several
questions from the Board. The Public Hearing was opened at 6:20 p.m. Mr. Scott
Bradley of 10 Paigebrooke Lane in Westlake spoke in favor of the application and
suggested that the one-foot restriction on the height of the letters makes little sense if, for
example, Rennaissance Hotel were to use only a single "R" for its logo sign that
otherwise would fit within the overall size limitation. As no one else wished to address
the Board the Public Hearing was closed at 6:22 p.m. There was a motion by Mr. Held,
seconded by Mr. Brown,to approve the application filed by Diego's Restaurant to
alleviate a hardship. Mr. Sparrow suggested that due to the development expected in the
future the Board of Aldermen should take a look at the current sign standards. There
was no further discussion and the motion carried unanimously.
Item#4: There was a motion by Mr. Brown, seconded by Mr. Frey,to adjourn. There
was no discussion and the motion carried unanimously.
The meeting was adjourned at 6:25 p.m.

SUBJECT: EMERGENCY SERVICES TEMPORARY FACILITY VARIANCE
REQUEST

Emergency Services variance request from the requirements of Article IV, Section 5B of
the Westlake Unified Development Code regarding a 90-day time limit for temporary
structures.
RECOMMENDATIONS
Staff recommends approval of the variance by granting a 24-month extension to the time
limits set forth in the Code.
BACKGROUND
The Town established Fire and EMS services June 1, 2002. In order to provide these
services, a temporary site at 2900 Dove Road was prepared to accommodate the
necessary dormitory and apparatus storage requirements until permanent facilities are
constructed. A 24-month variance was granted for the operation of Emergency Services
from this site.
This request is for an extension of the original variance for an additional 24-month
period. This site has functionally been an acceptable temporary site due to the
improvements on site. The continued operation of Emergency Services from this site
would be both economically and operationally prudent for the Town and the citizens of
Westlake until permanent facilities are obtained.

SECTION 4 FLOODPLAIN AREAS
4.1 Permitted Uses
The following uses shall be permitted within that portion of a district which is
designated as being within a Floodplain by the Town Engineer, provided they are
allowed in the underlying zoning, and that they meet any additional requirements
established in Article XIV Fioodplains and the City's Floodplain Regulations:
A. Agriculture.Agricultural activities including the ordinary cultivation of land or
legal forms of animal husbandry.
B. Utilities. Local utilities
C. Parks and Recreation. Public or private parks, community centers,
playgrounds, public golf courses.
D. Private Recreation. Private commercial open area amusements such as golf
courses, driving ranges, archery courses and similar uses when approved by a
Specific Use Permit.
E. Private Open Space. Private open spaces as part of a Planned Development
(PD) District, provided such use does not interfere with the continuity of the
Town's Open Space System.
4.2 Dumping, Excavating or Filling Floodplain
Any dump, excavation, storage or filling operation within that portion of a district
having a Floodplain designation shall require a permit, which must be approved by
the Board of Aldermen, before such operation is begun. However, if those
operations in the floodplain were specifically approved as part of a site plan
approval by the Board of Aldermen, then a permit may be issued by the Town
Engineer.
4.3 Local Flooding May Occur in Other Areas
The fact that land or property is or is not within a district having a Floodplain
designation shall not constitute assurance that such land or property is not subject
to local flooding and the designation of Floodplain in this ordinance shall not be so
interpreted.
SECTION 5 TEMPORARY STRUCTURES
5.1 Conditions
A Temporary Structure is one which is used for a limited period of time. It may be
manufactured on-site or off-site, but is temporary in nature, and only used until a
permanent structure can be constructed or refurbished. All Temporary Structures
shall be required to comply with the following:
A. Permits. No temporary structure may be constructed on site, or brought on site
until a Building Permit for its construction and siting has been issued.
B. Time Limit.The time limit for all Temporary Structures shall be ninety (90) days;
except for on-site construction offices which shall be limited to the time required
for the actual on-site construction of the structure or facility, or one year,
whichever is less. Any further extension shall require Board approval.
