TOWN OF WESTLAKE, TEXAS
ZONING BOARD OF ADJUSTMENT
AUGUST 8, 2005
PRESENT: Chairman Don Redding and Members Buddy Brown, Bill Frey, Fred Held, and
Larry Sparrow
ABSENT: None
OTHERS PRESENT: Town Manager Trent Petty, Town Attorney Stan Lowry, Town
Secretary Jean Dwinnell, and Construction Inspector Jim Taylor
1. CALL TO ORDER.
Chairman Don Redding called the meeting to order at 6:34 p.m. and announced a quorum.
2. REVIEW AND APPROVE MINUTES OF MEETING HELD MAY 2, 2005.
Mr. Brown moved, Mr. Frey seconded the motion to approve the minutes of the Zoning Board of
Adjustment meeting held May 2, 2005, as presented.
There was no discussion and Chairman Redding declared the motion carried unanimously.
3. CONSIDER A REQUEST FOR A VARIANCE FROM THE MINIMUM SIDE -
YARD SETBACK REQUIREMENT AT 1626 FAIR OAKS COURT IN
GLENWYCK FARMS.
Town Manager Trent Petty reviewed the proposed variance request and advised that there is a
hardship based on the irregularly shaped lot and recommended approval.
Mr. Brown moved, Mr. Held seconded the motion to approve the requested variance based on
the hardship as explained by the Town Manager.
Discussion ensued regarding the Town's policies and location of easements.
There was no further discussion and Chairman Redding declared the motion carried
unanimously.
4. CONSIDER A REQUEST FOR A VARIANCE FROM THE INTERNATIONAL
FIRE CODE AT 2100 CEDAR ELM TERRACE.
Chairman Redding explained that this item had been requested prior to the change made by the
Board of Aldermen recently.
Town Manager Trent Petty reviewed the proposed variance request and advised that there is a
hardship based on the unreasonable requirements of the Code regarding sprinkler systems in
buildings.
Mr. Sparrow moved, Mr. Held seconded the motion to approve the requested variance based on
the hardship as explained by the Town Manager.
There was no discussion and Chairman Redding declared the motion carried unanimously.
5. ADJOURNMENT.
Mr. Frey moved, Mr. Sparrow seconded the motion to adjourn.
The motion carried and Chairman Redding declared the meeting adjourned at 6:40 p.m.

Item:
Conduct a Public Hearing and take appropriate action regarding an application for
variances to the Code of Ordinances for Temporary Facilities at the Westlake Municipal
Complex
Recommendation:
Staff recommends approval
Background:
As a result of Academy expansion and in accordance with Board directive, staff will
begin vacating space this summer. Additional space for the staff is being proposed by
adding a temporary building for the Municipal Court to the complex, as well as, two (2)
temporary parking areas. In order to permit these temporary improvements, it is
necessary to grant a variance to the length of time permitted by the Town's Code for a
temporary building and temporary parking lots. In addition, the Board should be aware
that temporary facilities are not listed as permitted for the category of Governmental Use.
For these reasons, the variances must be considered.
The temporary building for the Municipal Court is to be located in the northeast area of
the campus, north of the retention pond. The Unified Development Code states in Article
IV, Permissible Uses, Section 9, Temporary Accommodation for Employees, Customers
and Visitors, that temporary facilities are permitted for a maximum of thirty (30) days.
The Town will need a variance to this provision of the Code for a time period of three (3)
to five (5) years.
A temporary parking lot near the proposed temporary Municipal Court building will
provide 24 spaces for court customers. A temporary parking area is also proposed on the
west side of the complex behind the Recreation Center. This area will provide 84
additional parking spaces that will be useful for special events on the campus that draw
larger numbers of people. In addition, this parking lot will serve as another location for
drop -off and pick -up of students. A long lane for queuing of vehicles will be created that
will improve circulation of traffic during peak hours.
The Town's Engineering Standards were recently amended to permit temporary parking
lots for a maximum period of one (1) year. The proposed temporary parking facilities
will likely be in place from three (3) to five (5) years. The Town will need a variance to
Article II, Roadway Facilities, Section 8, Temporary Parking Facilities, of the
Engineering Standards.
