CONDUCT A PUBLIC HEARING AND TAKE APPROPRIATE ACTION REGARDING AN APPLICATION FOR A VARIANCE REQUEST REGARDING ALLOWABLE HEIGHT AND PLACEMENT OF A SOLID MASONRY FENCE/ SCREENING WALL, LOCATED AT 1606 FAIR OAKS DRIVE IN GLENWYCK FARMS ADDITION, BLOCK A, LOT 26. 4. Kim Sutter, TRMC, Town Secretary MINUTES OF THE TOWN OF WESTLAKE, TEXAS ZONING BOARD OF ADJUSTMENT MARCH 26, 2007 PRESENT: Chairman Don Redding and Board Members Larry Corson, and Bob Timmerman ABSENT: Board Member Buddy Brown and Fred Held OTHERS PRESENT: Town Manager Trent Petry, Town Attorney Michael Kallus, Town Secretary Kim Sutter, DPS Director Don Wilson, and Facilities Director Troy Meyer. 1. CALL TO ORDER. Chairman Redding called the meeting to order at 7:16 p.m. 2. REVIEW AND APPROVE MINUTES OF THE MEETING HELD ON OCTOBER 24, 2005. MOTION: Member Redding made a motion to approve the minutes as presented. Member Corson seconded the motion. The motion carried by a vote of 3- 0. 3. CONDUCT A PUBLIC HEARING AND TAKE APPROPRIATE ACTION REGARDING AN APPLICATION, V- 07 -01, FILED BY WB TEXAS RESORT COMMUNITIES REQUESTING A VARIANCE REGARDING THE TIME RESTRICTION ON A TEMPORARY STRUCTURE LOCATED AT 1405 FOUNTAIN GRASS COURT, VAQUERO — PHASE 1. Town Manager Trent Petty presented the case to the Board. He advised the board that the applicant was granted a variance in June 2002 for a period of two -years with a one year extension. The applicant has filed an application for a one year time period with a one year extension. Chairman Redding opened the public hearing at this time. Chairman Redding opened the public hearing at this time. There being no one requesting to speak, Chairman Redding closed the public hearing. Discussion ensued with regard to whether the circumstances constituted a legal hardship. MOTION: Member Corson made a motion to approve the application for a variance for a temporary structure for a period of one year, with the condition that if construction begins on Precinct Line Road the request for the additional year would not be granted. Member Timmerman seconded the motion. The motion carried by a vote of 3 -0. 4. ADJOURNMENT. There being no further business to come before the board, Chairman Redding asked for a motion to adjourn. MOTION: Member Corson moved to adjourn the meeting. Member Timmerman seconded the motion. The motion carried by a vote of 3 -0. The motion carried and Chairman Redding declared the meeting adjourned at 7:26 p.m. Approved by the Zoning Board of Adjustment on August 27, 2007. Don Redding, Chairman ATTEST: Kim Sutter, TRMC, Town Secretary Town of Westlake Memo To: The Honorable Chairman Don Redding and Members of the Zoning Board of Adjustment From: Trent Petry, Town Manager Subject: Meeting of August 27, 2007 Date: August 22, 2007 ITEM Conduct a Public Hearing and take appropriate action regarding an application for a Variance request to the Westlake Code of Ordinance Section 101 -121 regarding the allowable placement and building height of a solid masonry fence /screening wall, located at 1606 Fair Oaks Drive in the Glenwyck Farms Addition, Block A, Lot 26. RECOMMENDATIONS The ZBA may consider the request to constitute a legal hardship subject to the evidence presented by the applicant. BACKGROUND Section 101 -121 (h) prohibits solid fencing higher than 3.5 ft in front of a building setback line. The proposed masonry fence depicted on the attached drawing contemplates an 8' tall masonry fence extending beyond the rear building setback line. The applicant has requested the variance to block vehicle lights on north bound Randol Mill from shining into the residence. THE BACKYARD OF RESIDENCE IS 3' TO 4' BELOW THE STREETS OF RANDALL MILL AND DOVE ROAD THAT MEET DIRECTLY BEHIND PROPERTY. ENCLOSED ARE PICTURES SHOWING THE VIEW OF TRAFFIC BEHIND RESIDENCE. Hurst, TX 76054 Re: 1606 Fair Oaks Drive - Privacy wall /fence permit application. Dear Sir, Your application and plans have been reviewed and found to be in conflict with the Town of Westlake Unified Development Code. The specific sections and conflicts are: 1. Section 1.8 Fences, A. "Fences may be built a maximum of seven (7) feet in height ". The plans show the proposed height of the fence as eight (8) feet tirith columns having caps slightly higher. 2. Section 1.8 Fences, A. 2. "no solid fencing greater than 3.5 feet in height may be built in front of a building setback line ". The plans show the proposed fence to be located between the building line and the adjacent roadway. It is our interpretation that this area is "in front of the building setback line. In order to receive a permit for the construction of the fence, either the plans will need to be modified to comply with the sections above or obtain a variance to these regulations from the Zoning Board of Appeals.
