SECTIONS 551.071 THROUGH 551.076 AND SECTION 551.087 OF THE TEXAS
GOVERNMENT CODE.

Consider a Resolution accepting a sealed bid for surplus property and approving sale of the property.
ITEM

BACKGROUND
Between 2003 and 2005, the Westlake Department of Public Safety purchased a total of ten (10)
Kimber .45 ACP pistols for our tri-certified officers. Since that time, the department no longer
carries police officer commissions, eliminating the need for department-issued weapons.
Request for Bids (RFB) were advertised on March 30, 2010. The City of Hurst Police Department
submitted the highest bid, and is one of the few law enforcement agencies in this area that issues
the same model of weapon. The bid is at or above fair-market value, presenting Westlake with a
unique opportunity to liquidate our surplus property to a neighboring agency, while ensuring the
weapons remain in public service.
$7,000 addition to the General Fund balance.
FUNDING
Staff recommends approval.

RESOLUTION NO. 10-11
A RESOLUTION TO FORMALLY ACCEPT A SEALED BID FOR SURPLUS
TOWN PROPERTY AND APPROVING THE SALE OF PROPERTY TO THE
HURST, TEXAS POLICE DEPARTMENT.
WHEREAS, the Town of Westlake recognizes the need to liquidate surplus
property no longer needed by its operations at; and,
WHEREAS, the Town of Westlake owns ten (10) surplus Kimber .45 ACP
firearms no longer used by the Westlake Department of Public Safety; and,
WHEREAS, the City of Hurst Police Department has submitted the highest
sealed bid of seven-thousand dollars ($7,000); and,
WHEREAS, Town of Westlake staff has determined that the City of Hurst’s bid
is fair-market value or higher for this property, and acceptance of this bid is of mutual
benefit for both municipalities;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF WESTLAKE:
SECTION 1.
That the Town of Westlake Town Council does hereby accept the
bid of seven-thousand dollars ($7,000.00) and approves the sale of ten (10) surplus
Kimber .45 ACP firearms to the Hurst, Texas Police Department.
SECTION 2.
This sale of this property is strictly limited to the items specifically
identified on Exhibit “A”, and the property shall transfer ownership to the City of Hurst,
Texas Police Department upon receipt of payment in full.
SECTION 3.
That this Resolution shall become effective upon the date of its
passage.
PASSED AND APPROVED ON THIS 3rd DAY OF MAY 2010.
