PLANNING AND ZONING COMMISSION MEETING
JULY 26, 2007
PRESENT: Chairman Bill Greenwood, Commissioners Tim Brittan, Walter Copeland, Allen
Heath, and Sharon Sanden.
ABSENT: None.
OTHERS PRESENT: Town Manager Trent Petty, Town Attorney Michael Kallus, Town
Secretary Kim Sutter, DPS Director Don Wilson, Executive Assistant
to the Town Manager Ginger Awtry, and Town Engineer David
McCarver.
1. CALL TO ORDER.
Chairman Greenwood called the meeting to order at 7:10 p.m.
2. REVIEW AND APPROVE MINUTES OF THE PLANNING AND ZONING
COMMISSION MEETING HELD ON JUNE 28, 2007.
Chairman Greenwood introduced the item and asked for a motion.
MOTION: Commissioner Heath made a motion to approve the minutes as presented.
Commissioner Sanden seconded the motion. The motion carried by a vote of
5-0.
3. CONSIDER AND TAKE APPROPRIATE ACTION REGARDING AN
APPLICATION FOR A PRELIMINARY PLAT BEING 54.77 ACRES, DESCRIBED
AS FOLLOWS: 1) CHARLES M THROOP, A 1510, Tr 7A2 & Tr 7A5 BEING
APPROXIMATELY 13.72 ACRES OF LAND AT 1280 DOVE ROAD; 2) CHARLES
M THROOP, A 1510, Tr IB03 BEING APPROXIMATELY .94 ACRES OF LAND
AT 2650 SAM SCHOOL ROAD; 3) TW MANN, A 1107, Tr 1113 & A 1510, Tr 1B1
BEING APPROXIMATELY 2.35 ACRES OF LAND AT 2698 SAM SCHOOL

Town Manager Petty introduced the case and advised that the Board of Aldermen approved
the zoning change request and agreed to the following stipulations for the preliminary plat.
1. The preliminary plat will illustrate all floodplain within the development being dedicated
to the Town as a separate lot and filed by separate instrument.
2. The preliminary plat will illustrate a maximum of seven (7) lots on the west side of the
floodplain, each being a minimum of 43,560 square feet; and east of the floodplain there
will be a maximum of 21 lots which will be at or near 40,000 square feet each.
3. The preliminary plat will illustrate a varying 20 foot rear yard setback allowance.
Mr. Petty advised that staff has reviewed the plat and finds it to be consistent with the
Board's desires and staff is recommending approval.
The applicant, Paul Spain, 2200 Estes Park Drive, Southlake, and Mr. Curtis Young were
present to address the questions of the Commission.
Chairman Greenwood and Commissioner Heath stated that they felt that all lots should
comply with the town's 43,560 square foot lot size, but would respect the wishes of the
Board of Aldermen with regard to the recommended changes.
MOTION: Commissioner Sanden made a motion to recommend approval of the
preliminary plat as presented. Commissioner Copeland seconded the motion.
The motion carried by a vote of 5-0.
4. CONDUCT A PUBLIC HEARING AND CONSIDER AN APPLICATION FOR A
MINOR RE -PLAT AT 1865 POST OAK PLACE; ON APPROXIMATELY 1.06
ACRES OF LAND FROM THE MEMUCAN HUNT SURVEY, GENERALLY
KNOWN AS VAQUERO PHASE 2B RESIDENTIAL ADDITION, LOT 4R, BLOCK
E, TARRANT COUNTY TEXAS. (TABLED AT JANE 28, 2007, P&Z MEETING DUE
TO INCOMPLETE APPLICATION)
Town Manager Petty advised the Commission of the request and stated that the minor replat
will take the lot back to the original configuration of two lots.
Chairman Greenwood opened the public hearing.
There being no one requesting to speak, Chairman Greenwood asked for a motion to close
the public hearing.
MOTION: Commission Brittan made a motion to close the public hearing. Commission
Heath seconded the motion. The motion carried by a vote of 5.0
Chairman Greenwood declared the public hearing closed and asked for a motion.
MOTION: Commissioner Brittan made a motion to recommend approval of the
application for a minor replat at 1865 Post Oak Place. Commissioner Heath
seconded the motion. The motion carried by a vote of 5-0.

5. CONDUCT A PUBLIC HEARING AND CONSIDER AN APPLICATION FOR AN
AMENDMENT TO THE CONCEPT PLAN IN PLANNED DEVELOPMENT 1,
OWNED BY MAGUIRE PARTNERS, IN THE WESTLAKE/SOUTHLAKE
ADDITION NO. 1; LOT 1, BLOCK 1 ON APPROXIMATELY 7.42 ACRES OF
LAND GENERALLY LOCATED AT THE NORTHWEST CORNER OF STATE
HIGHWAY 114 AND SOLANA BOULEVARD.
Town Manager Petty advised that the case will be presented to the Commission at the
August 23, 2007, regular meeting.
MOTION: Commissioner Copeland made a motion to table this item to the August 23,
2007, Planning and Zoning Commission meeting. Commissioner Brittan
seconded the motion. The motion carried by a vote of 5-0.
6. CONSIDER AN APPLICATION AND TAKE APPROPRIATE ACTION
REGARDING A FINAL PLAT DESCRIBED AS BEING APPROXIMATELY 40.779
ACRES OF LAND IN THE CHARLES MEDLIN SURVEY ABSTRACT NO. 1084,
THE WILSON MEDLIN SURVEY, ABSTRACT NO. 1958, AND THE MEMUCAN
HUNT SURVEY, ABSTRACT NO. 756, TOWN OF WESTLAKE, TARRANT
COUNTY, TEXAS AND UNDER COUNTY CLERKS NUMBER 98-R0091521 OF
REAL PROPERTY RECORDS, DENTON COUNTY, TEXAS; GENERALLY

Town Manager Petty introduced the item and advised the Commission that staff has
reviewed the final plat and is recommending approval conditioned upon the addition of the
proposed water and sewer easements to the plat.
MOTION: Commissioner Heath made a motion to approve the application for a final
plat as presented. Commissioner Copeland seconded the motion. The
motion carried by a vote of 5-0.
7. CONDUCT A PUBLIC HEARING AND CONSIDER AN APPLICATION FOR A
ZONING CHANGE REQUEST TO RESIDENTIAL AIRPARK (RA) FOR THE
TRACT OF LAND DESCRIBED AS BEING LOT 1, BLOCK 1 OF THE WATTS &
LANGER SUBDIVISION, HENRY ODELL SURVEY, ABSTRACT NO. 1196 AND
THE E. MCANEAR SURVEY, ABSTRACT NO. 1005, TARRANT COUNTY,
TEXAS; MORE COMMONLY KNOWN AS 5990 STAGECOACH CIRCLE,
CURRENTLY ZONED RESIDENTIAL -1 ACRE (R-1).
Town Manager Petty advised the Commission of the zoning cases items 7 through 50, and
explained the process for considering the cases. Mr. Petty further advised that no action will
be taken on the following items due to reasons stated:

Mr. Petty advised that the cases are scheduled to go before the Board of Aldermen at the
Board's August 27, 2007, regular meeting. He further advised that Commissioners Heath
and Sanden have filed conflict of interest affidavits with the Town Secretary and will not
participate in the discussion or consideration of items 7 through 50.
Chairman Greenwood opened the public hearings for item numbers 7 through 50.
George Ledak, 1220 Mt. Gilead, Keller, and owner of a lot located at 5949 Stagecoach Hills,
Westlake, asked if any environmental assessments were conducted with regard to
underground fuel storage tanks, and if contaminated is the landowner responsible.
Town Manager Petty advised that there are no provisions in the zoning process to require
environmental assessments, and any contamination abatement is the responsibility of the
landowner.
Vernon Hamilton, 5924 Steve Court, expressed his concerns that the zoning associated with
the Residential Airpark "RA" category appears more restrictive than the previous R-1
zoning as it relates to accessory buildings.
Town Manager Petty advised that the Board's intent is to limit the number of accessory
buildings on a single lot.
There being no other requesting to speak, Chairman Greenwood asked for a motion to close
the public hearings.
MOTION: Commissioner Copeland made a motion to close the public hearings.
Commissioner Brittan seconded the motion. The motion carried by a vote of
3-0.

MOTION: Chairman Greenwood made a motion to recommend approval of the final
plat as described by the Town Manager. Commissioner Copeland seconded
the motion. The motion carried by a vote of 3-0. Commissioner Heath was
not in the room and Commissioner Sanden had not returned to the dais for the
vote.
53. ADJOURNMENT.
There being no further business to come before the Commission, Chairman Greenwood
asked for a motion to adjourn the meeting.
MOTION: Commissioner Britian made a motion to adjourn the meeting. Commissioner
Copeland seconded the motion. The motion carried by a vote of 3-0.
Commissioner Heath was not in the room and Commissioner Sanden had not
returned to the dais for the vote.
Chairman Greenwood adjourned the meeting at 7:58 p.m.
