The motion c��ied unaz�imously. Ttem#�; Co�duct a Puhlic Hearing to consid�r a specific use permit application filed by Fidelity Investments to drill a private water we11. Chairman Greenwood opened the public hearing �t '�:?� p.tl_. by a.sking for_com�nents from the staf�. Mx. Petty,the Tovvn Manager, explained this iten3*��1h�, Gommission and gave the staff recammendatioz�of approval. As no ane else wished to au�'.��ss the Commission regarding this matter there was a motian by Commissioner 13arry, se�or�'.-:d by Carnmissioner Sanden,to close the Public Hearing. The motion passed unanirnously �nc:the�ubli�� Hearing�was closed at 7:38 p,m. There was a motion by Com�nissianer Sa�den., secoa'�w�l�y Cor�3missioner Barry, to recornmend approval of this item to th� Board Qf�ldermen. The �otior�carried unanimously. IYem#�: �o�duct a P�blic Hearing to ce�ns�der a fina�plat far PD 3-1 (�'hase 1 Residential adc�.ition and Golf Course} filed by �V,B, Texas Resort Comtnuni#ies. The Public Hearing was opened at 7:39 p.m. Mr. Petty, the Tawn Nlanager, addr�ssed the Commissioners 4n this item. Steve Yetts af W.B. T�xas Resort Cornmunities and Frar�lc Abbot with Kirnley Horn Assac., Ine. represer�ted the applicant. There was a lengthy question and ansr�ver sesszon after which there was a motion by Cornrnissioner Barry, secondeci by Carnmissioner Sanden, to close the Public Hearing. The rnotion carried unanirnously and�i�e Fublic Hearing was closed at 7:57 p.rn. Th�re was a rr�otion by Commissioner Sanden, seconded by Cor�r�issioner Barry, to recornrnend appxoval of this final plat subject fo the followinb coz�ditioils: 1. Th�Precinct Line 1Raad and Dove Road rights-of-way (adjacent to P17 3-I} shall he dedicated to the Town by separate instru�ent prior to acceptanee of the public impravements. 2. �The project and street names shall be added to the titXe block of the final p�at prior to tz�ing. Easer�.ents shall b� provided by separate instruinent for the Town duet banks internal to the ° ,3evelapment and�rithin the future Frecinct L�ne Ro�.d and Dov�Road rights-af-waya 4. The Own�r shail construct the Town duet bank as required by the Towz�internal ta tk�e project. The Owner�hall be reimbursed by the Town after permit fees are collected from each lot of the subdivisian. 5. The Owner shall es�row or provide a sufficient surety instnunent ec�ual ta one-third (1/3� of the cost of the design ar�d construction of the Town's duct bank in future Precinct Line Road and comply with � Secti�n 4, Part C, of the Developer's Agree�nent prior to filing the fir�al p�at with Tazrant County. The motion carried t�z�anim�ously. Item#5: Motion by Cornmissioner�arry, seconded by Con�missianer Sanden,to adjourn, 'The mot�on carried unanimousiy.
