HomeMy WebLinkAbout12-06-96 PZ MinTOWN OF WESTLAKE, TEXAS MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING AND PUBLIC HEARING DECEMBER 6, 1996 Present: Charla Bradshaw, Chairperson Don Redding, Member Dennis Wilson, Town Planner Ginger Crosswy, Town Secretary Also Present: Darcy Anderson, Alliance Development Co. Fred Balda, Alliance Development Co. Richard Kuhlman, Maguire -Thomas Partners Absent: Bill Greenwood, Member The meeting was called to order at 4.50 p.m. by Charla Bradshaw, Chairperson. Item 41: Amendments to Article X1II "Platting" of the Westlake Unified Development Code including provisions for public improvements, drainage and floodplain requirements; and Item #2: Amendments to Article XIV of the Westlake Unified Development Code including changes to the Planned Development {"PD") District requirements. Motion by Charla Bradshaw, seconded by Don Redding, to continue the Public Hearing on Items #I & 2 until the regular meeting of January 6, 1997, at 7:00 p.m.. Motion carried unanimously. Item 43: Consider the rezoning of certain tracts of land from the R-40 "Estate Residential" zone to R-200 "Country Residential" zone. The existing R-200 "Country Residential" zone of the Shelby Estates on the tracts are situated east of Pearson Lane and south of Dove Road and border the north and east. Fred Balda of Alliance Development Company spoke asking the Commission to delay the rezoning until a plan could be presented as to how the property in question will be developed including some assurance that the buffer around Shelby Estates would be preserved. Dennis Wilson, the Town Planner, stated that this would not help the property owners who at this time are apparently having a problem selling their property. After much discussion as to a different solution including changing the zoning on the remaining December 6, 1996 Planning and Zoning Commission Meeting Page 2 Circle T property in that area encompassing approximately 500 acres, there was a motion by Charla Bradshaw, seconded by Don Redding, and unanimously approved to submit to the Board of Aldermen the Commission's recommendation that the property in question around Shelby Estates be rezoned from R-40 to R-200. The Commission also suggested that the Board of Aldermen may wish to consider allowing the developer to recover the approximate number of whole units lost in this rezoning. If a PD is requested, consideration might be given to possibly waiving the application fee or a portion thereof, if the only variance from the current zoning sought by the PD is the increase in density to recoup the lost units. Any considerations suggested herein should be given only if a plan is presented within one (1) year of this rezoning. The only landowner present was Hillwood/Willowbend, Ltd.
