HomeMy WebLinkAbout03-29-99 PZ MinTOWN OF WESTLAKE, TEXAS MINUTES OF THE PUBLIC HEARING OF THE PLANNING AND ZONING COMMISSION March 29, 1999 Present: Bill Greenwood, Chairman Allen Heath, Member Sarah Brown, Member Don Redding, Member Buddy Brown, Member Paul Isham, Town Attorney Dennis Wilson, Town Planner Melanie Vanlandingham, Landscape Consultant Ginger Crosswy, Town Secretary Absent: No one. Chairman Greenwood opened the meeting at 7:03 p.m. Item #2: Presentation by John Hesseler of HKS Architects concerning the Fidelity Investments proj ect. Item #3: PUBLIC HEARING concerning an application filed by Sherry Gray for a rezoning of the property located at 2175 and 2205 N. Pearson Lane from "R-200" Country Residential District to a "PD" Planned Development District to allow the current kennel operation and expansion of the kennel. The Public Hearing was opened at 7:44 p.m. Tom Hanahan of 6239 LaCosa Drive in Dallas presented the rezoning request for the applicant. Ms. Gray then spoke to the Commission asking that they approve her application. Dennis Wilson, the Town Planner, recommended to the Commission that they deny the rezoning application. Chairman Greenwood opened the Public Hearing to take testimony from the audience. Those speaking in favor of the application were: Kim Poppke of 2200 N. Pearson Lane, Keller. Randy Allen of 5029 Northlake, Plano. Diane Albright of 620 Mt. Laurel, Bedford. Those speaking against the application were: Jennifer Fipps of 2155 Pearson Lane, Westlake. Richard Myers of 7400 Monticello Parkway, Colleyville. Kip Whitman of 3402 Crossgate Circle, Colleyville. Lee Hughes of 1005 Lakeridge Court, Colleyville. Ray Griffith of 1210 ©ttinger Lane, Keller. Jan Efurd of 732 Richland Lane W., Keller. Jean Ann Beach of 1549 Hudonall Farm Road, Keller. Stephen Thornton of 13187 Thornton Drive, Westlake. Sherry Gray, the applicant, spoke in rebuttal. Pearson Lane from "R-200" Country Residential District to a "PD" Planned Development District to allow the current kennel operation and expansion of the kennel. After much discussion of the subject by the Commission there was a motion by Commissioner Greenwood, seconded by Commissioner Buddy Brown, to recommend that the application be denied by the Board of Aldermen. The motion carried unanimously. At 9:3 5 p.m. Chairman Greenwood announced that the meeting would be recessed for 10 minutes. The meeting was reconvened at 9:48 p.m. Item #5 PUBLIC HEARING concerning a preliminary plat, an application for a specific use permit to allow a gated community and a developers agreement filed by Warren Clark Development for the property located at 1650 W. Dove Road, approximately 2100 feet west of San School Road, adjacent to Dove Road. The Public Hearing was opened at 9:48 p.m. by Chairman Greenwood. Mr. Greenwood announced that the Commission would not address the developers agreement or the preliminary plat tonight because they were not completed. David McMahan of Four Peaks Development, Inc. gave an overview of the request for a specific use permit to allow a gated community. Dennis Wilson, the flown Planner, recommended that the Commission recommend denial of the application for a specific use permit. At this time Chairman Greenwood opened the Public Hearing to take testimony from the audience. Those speaking in favor of the application were: Joe Schneider with Hillwood Development Company, 13600 Heritage Parkway, Fort Worth.. Those speaking against the application were: Stan Parchman of 3000 Ottinger Road, Westlake. Annette Bush of 2220 Pearson Lane, Westlake. David Brown of 4050 Aspen Lane, Westlake. Stephen Thornton of 13187 Thornton Drive, Westlake. As there was no further testimony the Public Hearing was closed at 10:26 p.m. Item #6: Consider and take action concerning a preliminary plat, an application for a specific use permit to allow a gated community and a developers agreement filed by Warren Clark Development for the property located at 1650 W. Dove Road, approximately 2100 feet west of San School Road, adjacent to Dove Road. After much discussion by the Commission there was a motion by Commissioner Heath, seconded by Commission Buddy Brown, to recommend approval of the application to the Board with the stipulation that the gates only be closed from 10:00 p.m. until 6:00 a.m. The motion was then amended by Commissioner Greenwood, seconded by Commissioner Redding, to state that the gates would be closed from sun down until sun up but close no earlier that 8:00 pan. The amendment carried 4 for - I against (Allen Heath). The motion as amended carried 4 for - I against (Allen Heath). Item #7: PUBLIC HEARING concerning anzending Article III of the Westlake Unified Development Code to add a new category known as "R-80" Estate Residential 2 District which would require minimum lots of two acres. The creation of the new district will also result in amendments to Articles IV and V of the Unified Development Code. As there was no further testimony the Public Hearing was closed at 11:0$ p.m. Item #8: Consider and take action concerning amending Article III of the Westlake Unified Development Code to add a new category known as "R-80" Estate Residential 2 District which would require minimum lots of two acres. The creation of the new district will also result in amendments to Articles IV and V of the Unified Development Code. Motion by Commissioner Redding, seconded by Commissioner Buddy Brown, to recommend that the Board approve the new category known as "R-80" Estate Residential 2 District. The motion carried unanimously. Item #9: Motion by Commissioner Sarah Brown, seconded by Commissioner Buddy Brown, to adjourn. The motion carried unanimously.
