TOPIC: Consider approval the resolution authorizing the Town Manager to amend the
budget and authorizing expenditures related to the recent loss of the fire and
emergency medical services departments structure to include replacement and
disposal of the department’s related assets and authorizes the Town Manager to
sign on behalf of the Town of Westlake not to exceed a total of $200,000.00.

EXECUTIVE SUMMARY (INCLUDING APPLICABLE ORGANIZATIONAL HISTORY )
On December 31, 2015, Westlake Fire Department returned from an EMS call to find that the temporary
living quarters located at 2900 Drove Road was on fire. With help of the surrounding community fire
departments and their quick response in putting out the fire, the apparatus building was not damaged.
Staff is working to get temporary living quarters set up at 2900 Dove Rd. by January 9, 2015 and
replacing the current building and contents with the next 60 to 90 days.
The Town’s insurance company (TML Risk Pool) will make a determination this week if the building is a
total loss. If this determination is made, the Town will receive up to $60,250.00 to replace the building
structure. Contents of the building and other expenses related to temporary housing would be reimbursed
separately, based on actual costs incurred.
By passing this resolution it would allow staff to make purchases without going through the bid process
so that the fire department can get back into their normal operations as soon as possible.
This project would be funded by the general fund until payment is received for the insurance claim. All
proceeds from the insurance claim will be used to reduce the estimated $200,000 expenditure. The
general fund would only be used if the proceeds from the insurance claim does not cover all of the
estimated expenditures to complete the project.
RECOMMENDATION AND ATTACHMENTS
Town staff recommends approving resolution authorizing the town manager to amend the
budget and authorize expenditures related to the recent loss of the fire and emergency medical services
departments structure to include replacement and disposal of the department’s related assets and authorize
the Town Manager to sign on behalf of the Town of Westlake not to exceed a total
of $200,000.00.

RESOLUTION NO. 15-01
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE,
TEXAS, AUTHORIZING THE TOWN MANAGER TO AMEND THE BUDGET AND
AUTHORIZING EXPENDITURES RELATED TO THE RECENT LOSS OF THE FIRE
AND EMERGENCY MEDICAL SERVICES DEPARTMENTS STRUCTURE TO
INCLUDE REPLACEMENT AND DISPOSAL OF THE DEPARTMENT’S RELATED
ASSETS
WHEREAS, Section 551.045 of the Government Code authorizes the Town to conduct
an Emergency Meeting due to an imminent threat to public health and safety; and
WHEREAS, on December 31, 2014 fire station at 2900 Dove Road was damage by fire;
and,
WHEREAS, authorizing the Town Manager to expend such additional funds as may be
reasonable necessary up to but not exceed $200,000.00 and,
WHEREAS, the Town Council finds and concludes that an emergency exists that
requires the immediate appropriation of funds to preserve the property of the Town, to protect
the public health and safety of the Town's residents and to preserve the safety of the Town and
its citizens; a nd
WHEREAS, the Town Council finds that the passage of this Resolution is in the best
interest of the citizens of Westlake.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF WESTLAKE, TEXAS:
SECTION 1: That, all matters stated in the Recitals hereinabove are found to be true
and correct and are incorporated herein by reference as if copied in their entirety.
SECTION 2: That the Town of Westlake Town Council hereby approves and authorizes
Town Manager to amend the budget attached as Exhibit “A”, related to temporary fire
emergency and medical services facility and authorizes the Town Manager to sign on behalf of
the Town of Westlake not to exceed a amount not to exceed $200,000.00.
SECTION 3: If any portion of this Resolution shall, for any reason, be declared invalid
by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions
hereof and the Council hereby determines that it would have adopted this Resolution without the
invalid provision.

SECTION 4: That this resolution shall become effective from and after its date of
passage.
