ABSENT: Alderman Don Redding STAFF PRESENT: Town Manager Trent Petty, Town Secretary Kim Sutter, Finance Director Debbie Piper, Human Resource Manager Todd Wood, Facilities and Recreation Director Troy Meyer, Court Administrator Amanda DeGan, and DPS Director Don Wilson. 1. CALL TO ORDER. Mayor Bradley called the workshop to order at 4:54 p.m. 2. DISCUSS TOWN OF WESTLAKE PROPOSED BUDGET FOR FISCAL YEAR OCTOBER 1, 2007 THROUGH SEPTEMBER 30, 2008. Town Manager Petty advised the Board that staff is updating the long-term projections and will have the information available at the September 10, 2007, workshop. As follow-up to the July 23, 2007, workshop, Mr. Petty provided a handout to the Board outlining a list of long-range capital projects. Alderman Timmerman advised that he would like more discussion regarding the list as he feels the Town should take a more proactive approach to the hike and bike trails system. He further stated that his top two (2) priorities include a hike and bike system and the construction of the Arts and Science center. CONDUCT A PUBLIC HEARING ON AN ANNEXATION TO ENLARGE AND EXTEND THE CORPORATE BOUNDARY LIMITS OF THE TOWN OF WESTLAKE, TEXAS, TO INCLUDE AN APPROXIMATELY 48.293 ACRE TRACT OF LAND SITUATED IN THE M.E.P. & P.R.R.CO. SURVEY, ABSTRACT NO. 923 AND J. BACON SURVEY ABSTRACT NO. 1565, AND GENERALLY LOCATED NORTHWEST OF STATE HIGHWAY 170 AT ITS INTERSECTION WITH OTTINGER ROAD. Mayor Bradley introduced items 2, 3, and 4, and opened the public hearings for said items. Tim Brittan, 1905 N. Pearson Lane, asked if this action will clear up all legal issues associated with the boundary dispute and offered his congratulations to the Town. Town Attorney Lowry advised that additional steps are required. EXECUTIVE SESSION Mayor Bradley recessed the regular session of the Town of Westlake Board of Aldermen meeting at 7:15 p.m. so that the Board might consider the following in executive session. A. The Board will conduct a closed session under Texas Government Code section 551.071 to seek advice of counsel on legal matters involving pending or contemplated litigation, settlement offers, or other legal matters not related directly to litigation or settlement. Pending or contemplated litigation and settlement offers include but are not limited to the following: i. City of Roanoke v. To)a•n of We.stluke, Cause No. 02-01-002904-J'(Second Court ofAppeals) ii. Toirn of Westlake r. City of Roanoke (Johnny's Automotive tract), Caisse No. 200.3-20243-158 (1581h Judicial District Court ofDenton Counly, Texas) B. Mayor Bradley convened the executive session at 7:16 p.m adjourned at 7:31 p.m. 3. RECONVENE MEETING. The Board reconvened into regular session at 7:32 p.m. 4. EXECUTIVE SESSION ACTION. There was no action taken. 5. CITIZEN'S' PRESENTATIONS. There was no one present wishing to address the Board. The executive session 6. CONSIDER A RESOLUTION APPOINTING A MEMBER TO THE TEXAS STUDENT HOUSING AUTHORITY BOARD OF DIRECTORS; A MEMBER TO THE WESTLAKE HISTORICAL PRESERVATION SOCIETY; AND A MEMBER TO THE WESTLAKE ACADEMY FOUNDATION. Mayor Bradley introduced the item and asked for a motion. MOTION: Alderman Steger made a motion to approve the following board appointments: Texas Student Housing Authoritv Board of Directors Mr. George Ledak. to a term expiring June 2009 Westlake Academy Foundation Ms. Margo Hundley to a term expiring June 2008 Westlake Historical Preservation Society Ms. Teresa Walton to a term expiring June 2010. VOTE ON MOTION: Alderwoman Gallagher seconded the motion. The motion carried by a vote of 4-0. Town of Westlake Board of Aldermen Page 3 of 23 Regular Meeting August 27, 2007 7. CONSIDER AN ORDINANCE CALLING AND ORDERING A BOND ELECTION TO BE HELD ON NOVEMBER 6, 2007. Mayor Bradley introduced the item and asked for a motion. MOTION: Alderman Steger made a motion to adopt Ordinance No. 528, calling and ordering an election to be held on November 6, 2007, for the issuance of bonds in the amount of $2.5 million for the construction of an Arts and Science Center building. Alderman Corson seconded the motion. Mayor Bradley advised that, if approved, the bonds would not be issued before January 2008 and asked if the Board thought that the amount should be increased to $3 million. Town Manager Petty stated that a fund analysis would need to be prepared in order to advise the Board of the impact of increasing the amount. Alderman Corson stated that he is not agreeable to increasing the amount without further analysis by the bond counsel. Alderman Corson recalled in a previous workshop that there was discussion with regard to including language as a part of the ballot language or in the informational material that would state that at the point of time of the actual issuance the town would demonstrate that all cash necessary to complete the building is available. Town Attorney Lowry advised that the ballot language is dictated by State law; however, that type of language could be included as part of the motion. Discussion ensued with regard to the availability of funding from the Foundation before proceeding with the issuance, and the Board's desire to have the final cost of construction of the building before the election. It was the consensus of the Board to have a factual document prepared, with the intent of informing the voters that the bonds will not be issued unless the Board is comfortable with the proposed cost of the building. Alderman Timmerman advised that he is not comfortable with increasing the amount to $3 million. VOTE ON MOTION: The motion carried by a vote of 4-0. Mayor Bradley introduced the item. Town Manager Petty advised that the Planning and Zoning Commission approved the case by a unanimous vote. Mr. Paul Spain. the applicant, was present to address any questions from the Board. MOTION: Alderman Steger made a motion to approve the item as presented. Alderman Corson seconded the motion. CONDUCT A PUBLIC HEARING AND CONSIDER A RESOLUTION APPROVING A REPLAT IN PLANNED DEVELOPMENT 1; OWNED BY MAGUIRE PARTNERS-SOLANA LP, IN THE WESTLAKE/SOUTHLAKE ADDITION NO. 1; LOTS 1, BLOCK 1 FOR APPROXIMATELY 75.20 ACRES OF LAND GENERALLY LOCATED AT THE NW CORNER OF STATE HIGHWAY 114 AND SOLANA BOULEVARD. Mayor Bradley introduced the item. Town Manager Petty advised that items 12 and 13 are companion items and advised the Board of the cases. Mr. Petty stated that the Planning and Zoning Commission spent a significant amount of time discussing the building height as it exceeds the PD -1 zoning maximum height of 700 feet mean sea level (msl). Mr. Petty added that the first phase building height is proposed at 716 feet msl and the phase two building height is proposed at 721 feet nisi. Mr. Petty advised the Board that staff has worked with the applicant to preserve a number of trees and minimize light pollution by placing parking under the structures. Mr. Tom Allen, Partner and President of Solana, and Mike Silliman, Vice President of Leasing for Maguire Partners, were present. Ms. Kimberly Cole of Huitt-Zollars, on behalf of Maguire Partners, addressed the Board regarding the proposed development. Mayor Bradley opened the public hearing. There being no one requesting to speak, Mayor Bradley closed the public hearing. MOTION: Alderman Corson made a :notion to approve Resolution No. 07-51, approving the replat as presented. Alderwoman Gallagher seconded the motion. The motion carried by a vote of 4-0. 13. CONDUCT A PUBLIC HEARING AND CONSIDER AN ORDINANCE APPROVING AN AMENDMENT TO THE CONCEPT PLAN IN PLANNED DEVELOPMENT 1; OWNED BY MAGUIRE PARTNERS-SOLANA LP, IN THE WESTLAKE/SOUTHLAKE ADDITION NO. 1; LOT 1, BLOCK 1, FOR APPROXIMATELY 7.42 ACRES OF LAND GENERALLY LOCATED AT THE NW CORNER OF STATE HIGHWAY 114 AND SOLANA BOULEVARD. Mayor Bradley introduced the item and opened the public hearing. There being no one requesting to speak, Mayor Bradley closed the public hearing and asked for a motion. MOTION: Alderman Corson made a motion to adopt Ordinance No. 529 as presented. Alderman Steger seconded the motion. The motion carried by a vote of 4-0. Mayor Bradley introduced the item and asked for a motion. MOTION: Alderwoman Gallagher made a motion to approve Resolution No. 07-52, as presented. Alderman Steger seconded the motion. The motion carried by a vote of 4-0. 15. CONDUCT A PUBLIC HEARING AND TAKE APPROPRIATE ACTION REGARDING AN APPLICATION FOR A MINOR RE -PLAT OF LOT 4R, BLOCK E, VAQUERO, PHASE 2B RESIDENTIAL SUBDIVISION LOCATED AT 1865 POST OAK PLACE. Town Manager Petty advised the Board that approval of the application would take the lots back to the original configuration of two separate lots. Mayor Bradley opened the public hearing. There being no on requesting to speak. Mayor Bradley closed the public hearing and asked for a motion. Town Attorney Lowry advised that the Board has little discretion with regard to the case as it meets the PD -1 requirements. MOTION: Alderwoman Gallagher made a motion to approve the item as presented. Alderman Corson seconded the motion. The motion carried by a vote of 4-0. CONSIDER AN ORDINANCE AMENDING THE TOWN OF WESTLAKE CODE OF ORDINANCES, CHAPTER 90 TRAFFIC AND VEHICLES, SECTION 90-53, TRAFFIC CONTROL SIGNALS, ALLOWING FOR THE ADDITION OF THE SIGNALIZED INTERSECTIONS OF STATE HIGHWAY 170 AND ROANOKE ROAD 1N WESTLAKE, TEXAS; PROVIDING A PENALTY CLAUSE; PROVIDING FOR A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Town Manager Petty advised the Board that this action will add the intersection of State Highway 170 and Roanoke Road to the list of signalized intersections. MOTION: Alderman Steger made a motion to adopt Ordinance No. 530 as presented. Alderman Corson seconded the motion. The motion carried by a vote of 4-0. 17. CONSIDER AN ORDINANCE MAKING IT A CIVIL OFFENSE TO RIJN A RED LIGHT; AMENDING CHAPTER 90 OF THE WESTLAKE CODE OF ORDINANCES; PROVIDING FOR A CIVIL PENATLY; PROVIDING FOR CERTAIN DEFENSES; PROVIDING FOR SEVERABILITY; AND AN EFFECTIVE DATE. Keller Police Chief Mark Hafner was present and expressed his support for the item as it has been proven to reduce the number of red light violations. Chief Hafner shared some statistics with the Board, and identified the intersections of Trophy Lake Drive and SH 114, and SH 170 and Roanoke Road, as dangerous intersections due to red light violators, and advised the Board that Hwy 377 and SH 170 is also worthy of consideration. MOTION: Alderman Steger made a motion to adopt Ordinance No. 531 as presented. Alderman Corson seconded the motion. The motion carried by a vote of 4-0. Alderman Corson recommended the Board hold a public hearing to receive public input on the use of red-light cameras. Town Manager Petty advised the Board that that vendor will be asked to appear before the Board in October. 18. CONSIDER A RESOLUTION AUTHORIZING AN AGREEMENT WITH TRAFFIPAX FOR THE PROVISION OF EQUIPMENT, PROCESSING, AND RELATED SERVICES TO ENABLE THE TOWN OF WESTLAKE TO USE RED LIGHT CAMERA SYSTEMS AND SPEED ENFORCEMENT SYSTEMS TO ENFORCE THE TOWN OF WESTLAKE TRAFFIC LAWS WHERE PERMISSIBLE. Town Manager Petty advised the Board of the item, and stated that the contract includes a 90 -day penalty free cancellation clause. Mr. Petty stated that due to recent legislative changes, it is to the Town's advantage to accept the contract prior to September 1, 2007, and review the contract further. Town of Westlake Board of Aldermen Regular Meeting August 27, 2007 Page 8 of 23 MOTION: Alderman Corson made a motion to approve Resolution No. 07-53, with the addition of the addendum outlining the 90 -day penalty -free cancellation clause. Alderman Timmerman seconded the motion. The motion carried by a vote of 4-0. 19. CONSIDER A RESOLUTION AWARDING A CONTRACT TO ROGERS CONSTRUCTION FOR THE CONSTRUCTION OF THE 8" J. T. OTTINGER ROAD WATERLINE AND MISCELLANEOUS SANITARY SEWER REPAIRS. Town Manager Petty advised the Burd that the funding for this project is included in the FY 2006-2007 capital projects budget in the amount of $96,898.37. MOTION: Alderman Steger made a motion to approve Resolution No. 07-54. Alderman Timmerman seconded the motion. The motion carried by a vote of 4-0. 20. CONSIDER A RESOLUTION AUTHORIZING AN AGREEMENT WITH DANIEL'S IRRIGATION, INC., TO INSTALL AN IRRIGATION SYSTEM FOR THE MULTI-PURPOSE FIELD LOCATED ON THE WESTLAKE CIVIC CAMPUS. Town Manager Petty advised the Board of the item. MOTION: Alderwoman Gallagher made a motion to approve Resolution No. 07-55. Alderman Corson seconded the motion. The motion carried by a vote of 4-0. 21. CONSIDER A RESOLUTION AUTHORIZING AN AGREEMENT WITH PATE ENGINEERS TO PROVIDE ENGINEERING SERVICES FOR THE DESIGN AND LAYOUT OF THE SOUTH PARKING LOT EXTENSION, RELOCATION OF UTILITY LINES AND SITE DRAINAGE AND GRADING DESIGN FOR THE PROPOSED WESTLAKE PERFORMING ARTS AND SCIENCE CENTER. Town Manager Petty advised the Board of the item. MOTION: Alderman Steger made a motion to approve Resolution No. 07-56. Alderman Timmerman seconded the motion. Alderman Corson asked if the total preconstru,:tion cost is known. Town Manager Petty stated that the total amount is not known at this time; however, the previously authorized amount has not been exceeded. VOTE ON MOTION: The motion carried by a vote of 4-0. CONDUCT A PUBLIC HEARING AND CONSIDER AN ORDINANCE APPROVING A ZONING CHANGE REQUEST TO RESIDENTIAL AIRPARK (RA) FOR THE TRACT OF LAND DESCRIBED AS BEING LOT 1, BLOCK 1 OF THE WATTS & LANGER SUBDIVISION, HENRY ODELL SURVEY, ABSTRACT NO. 1196 AND THE E. MCANEAR SURVEY, ABSTRACT NO. 1005, TARRANT COUNTY, TEXAS; MORE COMMONLY KNOWN AS 5990 STAGECOACH CIRCLE, CURRENTLY ZONED RESIDENTIAL -1 ACRE (R-1). Mayor Bradley advised that Alderman Steger has filed a conflict affidavit with the Town Secretary for items 22 through 63. Mr. Steger stepped down and did not participate in discussion or consideration of these items. Mayor Bradley opened the public hearings for items 22 through 63. Allen Heath, 5944 Stagecoach Circle, advised the Board that the area where the properties are located does not include a runway, and asked how an area could be considered an air park district if there were no runway in the district. Mr. Heath expressed his concern that considerations brought forth previously were not considered. Town Manager Petty advised that the RA classification was created to facilitate access to the existing runway and did not seek to guarantee current or future rights and/or access to any runway. There being no others requesting to speak, Mayor Bradley closed the pubic hearings. MOTION: Alderman Timmerman made a motion to adopt Ordinance No 532, as presented. Alderman Corson seconded the motion. The motion carried by a vote of 3-0, with Alderman Steger filing a conflict of interest affidavit with the Town Secretary. 23.
