MINUTES OF THE REGULAR MEETING
OF THE BOARD OF ALDERMEN

Item #1:Mayor Bradley called the meeting to c rder at 7:00 p.m. by announcing; a quorum, consisting of
Alderman Frey, Alderman Brown, Alderman Ledding and Mayor Pro Tem Held.
Item #2: The Board convened into executive scssion at 7:03 p.m. as Mayor Bradley read the items to be
discussed. The Board recessed out of executive session at 7:36 p.m. and reconvened into open session at
7:40 p.m.
Item #3: Motion by Alderman Redding, seconded by Alderman Brown, that the Town Attorney be
authorized to represent the Town's interests in he matter known as Sherry Gray v Henry Barry, et al, at the
direction of the Town Manager, and file any ac tions and pleadings deemed advisable or necessary and to
ratify all actions heretofore taken by the Town Attorney. There was no discussion and the motion carried
unanimously.
Item #4: Citizens Presentation. No one wished to address the Board.
Item #5: Consider an Ordinance relating to ele ,tric franchise fee payments as calculated and paid under
Texas Utility Code §38.008 for existing franchises. Mr. Lowry, the Town Attorney explained this item to
the Board. There was a motion by Alderman F -ey, seconded by Aldermen Held, to adopt Ordinance No.
399. There was no discussion and the motion carried unanimously.
Item #6: Consider an Ordinance amending Orc.inance No. 395 to add a residential lot development fee
applicable to residential subdivisions containir g any portion of the Town duct bank. Mr. Petty explained
this item. There was a motion by Alderman Held, seconded by Alderman Brown, to adopt Ordinance No.
400_ There was no discussion and the motion carried unanimously.
Item #7: Consider a Resolution to appoint Akii i, Gump, Strauss, Hauer & Feld, L.L.P., to represent the
Town in legal and legislative matters, particuh rly before the Texas Legislatxire. Mr. Petty explained this
item. There was a motion by Alderman Held, seconded by Alderman Brown, to adopt Resolution No. 01-38.
There was no discussion and the motion Carrie i unanimously.

Item #8: Consider a Resolution to amend the budget for FYE September 30, 2002, regarding the DPS line
item. Mr. Petty explained this item. There was a motion by Alderman Redding, seconded by Alderman
Held, to adopt Resolution No. 01-39. There w�.s no discussion and the motion carried unanimously.
Item #9: Consider a Resolution appointing Ph} llis McConnell and Barbara Griggs to the Tree City USA
Advisory Committee. Mr. Petty explained this item. There was a motion by Alderman Frey, seconded by
Alderman Redding, to adopt Resolution No. 0 -40. There was no discussion and the motion carried
unanimously.
Item #10: Consider a Resolution amending the bylaws of each entity organi:Ked by the Town of Westlake
under the Higher Education Authority Act to p ermit the program administrator to have check writing
authority and to make other changes regarding financial administration. Mr. Petty explained this item. There
was a motion by Alderman Redding, seconded by Alderman Held, to adopt Resolution No. 01-41. There
was no discussion and the motion carried unanimously.
Consent agenda. Motion by Alderman Frey, seconded by Alderman Reddin ;, to approve the consent
agenda, which included the following:
A. Review and approve minutes of the regular meeting held on August 27, 21001.
Review and approve any outstanding bills.
There was no discussion and the motion carrie i unanimously.
Item #12: Motion by Alderman Heid, seconded by Alderman Brown, to adjouin. The motion carried
unanimously.
The meeting was adjourned at 8:12 p.m.
