HomeMy WebLinkAbout07-13-00 PZ Min42 Minutes of Planning & Zoning Page 1 of 3 TOWN OF WESTLAKE, TEXAS MINUTES OF THE PUBLIC HEARING OF THE PLANNING AND ZONING COMMISSION July 13, 2000 Present: Bill Greenwood, Chairman Allen Heath, Member Sharon Sanden, Member Hank Barry, Member Stan Parchman, Member Trent Petty, Town Manager Matthew Boyle, Town Attorney Dan Boutwell, Town Planner Ginger Crosswy, Town Secretary Absent: No one. Item #1: Chairman Greenwood opened the meeting at 7:30 p.m. Item #2: Motion by Commissioner Heath, seconded by Commissioner Sanden, to change the regular meeting date to the second Thursday of each month. The motion carried unanimously. Item #3: Continuation of a PUBLIC HEARING to consider an amendment to the Unified Development Code concerning Article III, Zoning District Map, Subsection 11 and Section 3, Purpose of Zoning Districts and Official Zoning Map, Article IV, Permissible Uses, and Article V, Zoning District Development Standards. Chairman Greenwood opened the Public Hearing at 7:35 p.m. Mr. Petty, the Town Manager, gave the background on this item. Mr. Boutwell, the Town Planner, gave the staff recommendation of approval. After a lengthy question and answer session the floor was opened to testimony from the audience. Mr. David McMahan, of Four Peaks Development, Inc., spoke against the approval of this item. Ms. BeAnn Sisemore, an attorney representing Roland Arthur, spoke in opposition. There being no further testimony there was a motion by Commissioner Barry, seconded by Commissioner Parchman to close the Public Hearing. The motion carried unanimously and the Public Hearing was closed at 8:32 p.m. There was a motion by Commissioner Heath, seconded by Commissioner Sanden, to recommend approval of this change to the Board of Aldermen. The motion carried unanimously. Item #4: Continuation of a PUBLIC HEARING to consider repealing Article IV of the Unified Development Code, Permissible Uses, Section 6, Satellite Dishes and replace it with a new Article IV, Permissible Uses, Section 6, Wireless Communications Facilities and to amend Article IV, Permissible Uses, Section 1, Land Use Schedule to replace "Satellite Dish" with "Wireless Communications Facility". Chairman Greenwood opened the Public Hearing at 8:35 p.m. Mr. Petty, the Town Manager, explained the background on this item. Mr. Boutwell, the Town Planner, gave the staff recommendation of approval and answered many questions. There being no one from the audience that wished to address the Commission, there was a motion by Commissioner Heath, seconded by Commissioner Sanden, to close the Public Hearing. One Abstention - Allen Heath Page 2 of 3 43 Item 45: Conduct a PUBLIC HEARING to consider an amendment to the Comprehensive Plan related to an approximately 9 acre parcel of land located south of Dove Road and east of Precinct Line Road and being out of the C.M. Throop Survey A-1510, as currently shown on the Comprehensive Plan of the Town. Chairman Greenwood opened the Public Hearing at 9:12 p.m. Mr. Boutwell, the Town Planner, explained this item to the Commission and recommended that low density residential would be the best use of this property. Ms. BeAnn Sisemore, an attorney representing Roland Arthur, spoke opposing the adoption of this item. Mr. Petty, the Town Manager, spoke regarding the traffic impact this parcel would have if left zoned as Retail. As no one wished to address the Commission further, there was a motion to close the Public Hearing by Commissioner Barry, seconded by Commissioner Parchman. The motion carried unanimously and the Public Hearing was closed at 9:26 p.m. There was a motion by Commissioner Barry, seconded by Commissioner Sanden, to recommend an amendment to the comprehensive plan related to an approximately 9 acre parcel of land located south of Dove Road and east of Precinct Line Road and being out of the C.M. Throop Survey A-1510, as currently shown as retail on the zoning map of the Town to low density residential zoning. The motion carried 4 for. One against - Allen Heath Item #6: Conduct a PUBLIC HEARING to consider an amendment to the Zoning Map of the Town to change zoning from "LR" Local Retail to "R-1" Estate Residential on an approximately 9 acre parcel of land located south of Dove Road and east of Precinct Line Road and being out of the C.M. Throop Survey A-1510, as currently shown on the zoning map of the Town. Chairman Greenwood opened the Public Hearing at 9:57 p.m. Mr. Boutwell, the Town Planner, recommended this change saying that low density residential would be the best use of this property. Ms. BeAnn Sisemore, an attorney representing the property owner, Roland Arthur, spoke in opposition. As no one else wished to address the Commission, there was a motion by Commissioner Sanden, seconded by Commissioner Heath, to close the Public Hearing. The motion carried unanimously and the Public Hearing was closed at 10:00 p.m. There was a motion by Commissioner Barry, seconded by Commissioner Sanden, to recommend approval of this amendment to the Board of Aldermen. There was much discussion concerning this matter. The motion carried unanimously. Item #7: Motion by Commissioner Parchman, seconded by Commissioner Barry, to adjourn. The motion carried unanimously.
