HomeMy WebLinkAbout03-24-97 TC MinTOWN OF WESTLAKE MINUTES OF THE SPECIAL CALLED MEETING OF THE BOARD OF ALDERMEN MARCH 24, 1997 Present: Scott Bradley, Mayor Carroll Huntress, Mayor Pro -Tem Ai Oien, Member Fred Held, Member Jerry Moore, Member Howard Dudley, Member Paul Isham, Town Attorney Terry Morgan, Town Legal Advisor Ernie Hedgcoth, Town Engineer George Belcheff, Town Engineer Cringer Crosswy, Town Secretary Absent: No one The Executive Session of the meeting was called to order at 6:40 p.m. by Mayor Bradley. The meeting was recessed at 7:48 p.m. and convened into open session at 7:50 p.m. Item #2: Citizens' Presentations: The Mayor told the assembly that two people had signed the appearance form to speak to the Board, Annette Bush and Abe Bush. Without any recognition from the Mayor, Alderman Howard Dudley attempted to make a motion (seconded by Al Oien) to declare this meeting a continuation of the March 19, 1997, regular meeting, thereby making the citizens' presentation unnecessary. Mayor Bradley told Mr. Dudley that he had not been recognized by the chair. Mayor Bradley then said that he had spoken with the Attorney General's office and was informed that under the circumstances this was a special called meeting; but that since the Board has the required quorum for a special called meeting, this is a moot point. Annette Bush then spoke, telling the Board that the citizens of Westlake would like the Board and the Mayor to work out their disagreement and restore the family attitude to this nice community. Mayor Bradley then recognized Abe Bush as speaker. Carroll Huntress then prevented Mr. Bush from speaking, stating that if the Mayor continued to ignore the motion on the floor and refused to act, then he as Mayor Pro -Tem would take over the meeting. Mr. Huntress stated again that the citizens' presentation was covered at the last meeting and since it was over there would be no more presentations. Bill Greenwood spoke from the audience telling Mr. Huntress that in trying to keep the citizens from speaking he was out of order and illegal and should be removed from the room. Mr. Huntress then stated 199 March 24, 1997 Special Meeting Page 2 that the Board of Aldermen - not the Mayor - controls this meeting. Mayor Bradley asked Mr. Bush if he wished to speak and Mr. Huntress interrupted "No, Mr. Bush will not speak". Mr. Bush then withdrew as a speaker in order to avoid further controversy. Item #3: The Mayor then announced the next item of business: Consider Ordinance No. 268 extending the moratorium on acceptance or processing of petitions to rezone land to planned development districts or to amend existing planned development districts. Motion by Howard Dudley, seconded by Carroll Huntress, to approve Ordinance No. 268. Motion carried unanimously. Item #4: The Mayor called for the next item of business: Consider Ordinance No. 269 extending the moratorium on acceptance or processing of all applications for subdivision or platting of land and exceptions thereto. Motion by Howard Dudley, seconded by Al Oien, to approve Ordinance No. 269. Motion carried unanimously. Item #5: The Mayor announced the next item of business: Consider a resolution ( a copy of which is attached and incorporated in these minutes) concerning the status of all of the Town's Attorneys, Planners, Consultants, Advisors and Engineers (with the exception of Metroplex Engineering Consultants). Motion by Howard Dudley, seconded by Carroll Huntress, to adopt the resolution as written. Mayor Bradley asked for any discussion. Mr. Huntress called the question. Motion carried 3 for 1 against - Fred Held 1 abstention - Jerry Moore Item 96: Mayor Bradley stated that this item could not be considered since the Town is under a temporary restraining order from the 3670' Judicial District Court, Denton, Texas, Cause No. 97-50203-367, prohibiting any action to reconsider Ordinance No. 270. The order was served on the Town while the Board was in Executive Session. All business which the Board could lawfully address having been completed, the chair then declared the meeting adjourned at 8:00 p.m. These minutes were never approved by any Board of Aldermen
