OF THE BOARD OF ALDERMEN
April 12, 1971
A Special Meeting of the Board of Aldermen of the Town of
Westlake, Texas, was held at the Circle "T" Ranch on the 12th day
of April, 1971, at 7:30 p.m. pursuant to a call of the Mayor.
Present were George H. Harmon, Jr., Mayor, Dewey G. Burger,
B. H. Campbell, S. B. Cathey, A. L. Odom, and Monroe Weaver,
Aldermen.
The Mayor called the meeting to order and announced that a
quorum existed for the transaction of business.
The Mayor stated that the first order of business was to
canvass the results of the election held on the 3rd day of April,
1971, for the election of municipal officers.
The returns of the election were examined and the proposed
Resolution No. 31 was read to the meeting, as follows:
RESOLUTION No. 31
WHEREAS, on the 3rd day of April, A. D. 1971, pursuant to
the provisions of Title 28, Revised Civil Statutes, the Election Code
of the State of Texas, and Resolution No. 30, heretofore adopted on
the 15th day of February, 19'x1, after due notice as by law provided,
the General Election to elect a Mayor, Five Aldermen, and a Marshal
for a term of one ,year was held within the limits of the Town of West-
lake, Texas; and
WHEREAS, on the 12th day of April, A. D. 1971, at a meeting
of the Board of Aldermen of said Town, the results of &aid Election
were canvassed by the Mayor in the presence of the Board of Aldermen
and said canvass showed the result thereof was as follows:

George H. Harmon, Jr. 12 votes
FOR ALDERMEN
B. R. Campbell 12 votes
S. B. Cathey 12 votes
A. L. Odom 12 votes
Dewey G. Burger 12 votes
Monroe Weaver 12 votes
FOR MARSHAL
D. E. McSpadden 12 votes
THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
That, the canvass of the result of said Election be, and is
hereby approved, and that George H. Harmon, Jr. having received the
highest number of votes for the office of Mayor is hereby elected to
said office and is to serve as such officer for the term of one year
from date hereof or until his successor is duly elected and qualified.
That, B. H. Campbell, S. B. Cathey, A. L. Odom, Monroe
Weaver, and Dewey G. Burger, having received the highest number of
votes for the office of Aldermen and D. E. McSpadden having received
the highest number of votes for the office of Marshal, serve as such
officers for the term of one year from date hereof or until their
successors are duly elected and qualified.

That, all such officers are hereby instructed to take
the oath of office as by law provided and file such oaths with the
Town Secretary.

Upon motion duly made by Dewey G. Burger and seconded by A. L.
Odom, the foregoing Resolution No. 31 was unanimously adopted.
The Town Marshal, D. E. McSpadden, then announced that he would
like to deputize Mr. Frank Schulz as Deputy Marshal of the Town of
Westlake, and submitted his name to the Board of Aldermen. Upon
motion duly made and seconded, the deputization of Mr. Frank Schulz
as Deputy Marshall of Westlake was unanimously approved.
The Mayor then stated that the third order of business would be
to consider the adoption of a resolution submitted by the North Texas
Council of Government which would provide for the local government of
the Town of Westlake to become a participating member of the afore-
mentioned North Central Texas Council of Governments by means of

representation of one of its elective public officials. Following
a full discussion, Mr. Burger's motion that the resolution be adopted
was seconded by Mr. A. L. Odom and the following Resolution No. 32
was adopted:

RESOLUTION NO. 32
WHEREAS, the area embraced within the physical boundaries of
the Counties of Collin, Dallas, Denton, Ellis, Johnson, Kaufman, Parker,
Rockwall, Tarrant, Wise, and Hunt are all Counties located in the north
central region of the State of Texas, which have joint and mutual environ-
mental, economic, social, or other problems which do or may require joint
and mutual surveys, studies, plans, and related actions in order to insure
the orderly growth and development of the region; and
WHEREAS, the above named Counties, as well as incorporated
municipalities and special-purpose districts located in the above named
Counties, comprise the North Central Texas Council of Governments with
the participating membership of the Council composed of an elective
public official from each participating local governmental unit vho is
designated by the respective governing body, according to the Bylaws and
said organisation has been authorized by the original agreement between the
respective governmental units for its creation, as well as enabling legis-
lation in support of the Council of Governments movement; and
WHEREAS, it is the opinion of the governing body of Town of
Westlake that it will be to its benefit and to the benefit of its citizens
as a whole to become a participating member of said organization;
NOW THEREFORE BE IT RESOLVED 3Y Tte Board of Aldermen of the
Town of Westlake.
SECTION 1. That the aforementioned local government may become
a participating member of the North Central Texas Council of Governments,
created for the purposes set out above, and the City Secretary be, and is
hereby authorized to apply for membership in the North Central Texas Council
of Governments by submission of this Resolution and the payment of the annual
dues established in accordance with the Bylaws of said organization.
SECTION 2. That this Resolution shall take effect from and after
its passage.
PASSED ON THIS THE 12th day of April, 1971 at a meeting of the
Board of Aldermen, of the Town of Westlake, Texas.

Upon motion duly made and seconded, Mr. George H. Harmon, Jr.
was elected by acclamation to represent the Town of Westlake to the
North Central Texas Council of Governments and to the North Central
Texas Regional Planning Commission.
The Mayor then stated that the fourth order of business would be
to consider the adoption of an Ordinance receiving and annexing territory
adjacent and contiguous to the Town of Westlake, Texas, and providing for
amending and correcting the official boundaries of said town as hereto-
fore adopted. He then presented to the meeting the following proposed
Ordinance in connection therewith:

AN ORDINANCE AMENDING ORDINANCE N0. 20, ADOPTED
FEBRUARY 13, 1960, RECEIVING.AND ANNEXING. TERRITORY ADJACENT
AND CONTIGUOUS TO THE TOWN OF WESTLAKE, TEXAS, AND PROVIDING
FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF SAID
TOWN AS HERETOFORE ADOPTED, AS AMENDED, AND PROVIDING THAT THE
EFFECTIVE DATE OF THIS ORDINANCE SIIALL. BE AS OF FEBRUARY 13,
1960 'THE EFFECTIVE DATE OF ORDINANCE NO. 20.
_ WHEREAS) on February 13, 1960, the Board of Aldermen
of the Town of Westlake adopted Ordinance No. 20 annexing to
said Town of 1,estlake certain territory described in said
ordinance; and,
WHEREAS, there was inadvertently included in said ordi-
nance a portion of a county road, which said portion of the
,county road is now part of the Town of Flower Mound, Texas; and.,
WHEREAS, -in order to correct the field notes of said
Ordinance ;;o. 20 so as to not include the portion" -'of said county
road now a part of the Town of Flower Mound, Texas, this ordi-
nance is adopted by the-8oard of Aldermen of the Town of Westlake;
, and,
• WHEREAS) this ordinance is adopted for the purpose of
disclaiming and waiving any interest which the Town of Westlake
may have in the territory described in Ordinance No. 202 adopted
on February 13, 1960, and which is presently within the limits
..of the Town of Flower Mound, Texas; now, therefore,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLA KE, TEXAS:
of the Town of .Westlake, heretofore adopted on February 13,
1960) be, and the same is hereby amended so.that the territory
annexed by the said Ordinance No. 20 be, and the same is here-
after described as follows, to -wit:
Beginning at a point in the North lines of the J. Eads
Survey A-.392, the Alvin 11. OVisley 124.37 acre tract and
the present corporate limits of the Town of Westlake,
said point also being 600 feet more or less East of the
Northwest corner of said corporate limits and the Alvin
11. Owsley 124.37 acre tract and in the East line of a
county road;
Thence North with the East line of said county road,
running along the• lVest line of the J. Henry Survey A-529,
2190 feet more or less -to a point in the Southeast line
of the old State Highway No. 10;
Thence North.39°39East with said Southeast line of
highway 435 feet more or less to a point in the South line
of a county road running -East and West along the North
line of the J. Henry Survey A-529;
Thence East with said South line of county road 1340 feet
more or less to corner of county road to the North; thence
North with the East line of county road running along the
West side of the T. Kelly Survey A-704 1571 feet
more or
less to a point in the Southeast line of the old State
Highway No. 10; -
Thence with said Southeast line Highway and with a 10 to
the left 225 feet more or less to a point;' thence continu-
ing on with said Southeast line of highway North 15°55'
East 1732.6 feet more or less, North 15045' East 1629.5
feet more or less to a point in the North line of the T.
Kelly Survey A-704 and the South line of the -S. Graham
Survey A-457, said point being 910 feet West of the North-
east corner of said Kelly Survey;
Thence North. 19°06' .IVest 166.4 feet to a point in the
Southeast line of the old U. S. I.ighway No. 377; thence in
a northeasterly direction with said Southeast line of
Highway 202.7 feet to a point; thence following the South--
east line of old U. S. Highway No. 377 and a 0'50' curve
to the left 670.3 feet to a point;
Thence with said Southeast line of highway North 13°47'
West 4733.4 feet, North 3°04' East 301.5 feet, North 13`47'
West 79.3 feet to a point of curve to the left; thence
with said 1 Curve to the left and east right of way line
of highway 306.0 feet to a point, said point being at
intersection with Vre•st line of Denton County Road No. 2;
Thence with West line of said county road 50°59' Nest 135.6

Thence East with said North line of the Kelly .Survey to
a point in the Gest line of old State Highway No. 10;

1629.5 feet, South 15°55' West 1732.6 to a point of
intersection with the lVest line of a county road to the
South;
Thence South with the said gest line of county road 2011
feet more or -less to a point'of intersection with the
North line of a county road to the Nest; thence West with
the said North line of county road 1435 feet more or
Tess to a point;
Thence. South and crossing said county road to an inter-
section with the Northwest line of the old State Highway
No. 10; thence South 39°39' West with the said Northwcst
line of highway 332 feet more or less to an intersection
with the lest line of a county road to the South; thence
South with said West line of county road 2340 feet more
or less to a point i•n the present corporate limits of the
' Town of Westlake, Texas;
Thence East 60 feet more or less to the point of beginning•
' and covering a tract of land containing 39.65 acres or
0.1619 square miles. _
SECTION 2. That the property hereinabove described
- and being adjacent and contiguous to the Town Limits of Westlake,
:Texas, be and it is hereby annexed and brought within the
corporate limits of said Town and made an integral part thereof
by virtue of'the provisions of Ordinance No. 20,•heretofore
adopted on February 13, 1960.
• SECTION 3. That the official map and boundaries of
the Town of Westlake, Texas, as heretofore adopted and amended,
be and it is hereby amended so as to include the aforementioned
-territory as part of the Town of Westlake Texas, as of February
13, 1960, and the map and boundaries of said Town of Westlake
• shall be corrected so as to conform to the above described terri-
tory and not as originally described in Ordinance No. 20, adopted
on February 13, 1960.
SECTION 4. That this ordinance shall become effective
and be in.full force and effect from and after its passarre and
approval by the ?;,- yor and ,duly attested by the Town Secretary,
and shall have the effect as amending Ordinance No. 20 as of
.-February '13 , 1960.

Following a full discussion of the proposed Ordinance and upon
a motion duly made by Mr. A. L. Odom and seconded by Mr. Dewey Burger,
the foregoing Ordinance No. 47 (amending Ordinance No. 20 adopted
February 13, 1960) was unanimously adopted by the Board of Aldermen.
There being no further business, the meeting was adjourned by
Mayor Harmon.
