OF THE BOARD OF ALDERMEN
FEBRUARY 15, 1969
A Special Meeting of the Board of Aldermen of the Town of Westlake, Texas,
was held at the Guest House, Circle "T" Ranch, on the 15th day of February, 1969,
at 11 o'clock A. M. pursuant to a call of Mr. R. W. Shytles, Attorney for the Town
of Westlake.

Present were Mr. A. L. Odom, Mr. A. H. Wilde, and Mr. H. S. Thrasher, Alder-
Mr. Odom called the meeting to order, and asked that the Aldermen sign a
Waiver of Notice of the meeting.
Mr. Odom then stated that the first order of business was to appoint a Mayor,
two Aldermen, and a Town Marshal to fill the unexpired terms made vacant since the
last meeting of Aldermen. He informed those present that the appointments would
be made pursuant to the statutory provisions of Article 11+6 of the Civil Statutes
of Texas, which Article states in Paragraph 6:.
"The Board of Aldermen shall fill, for the unexpired term, any
vacancies which may occur in any office created by this Chapter
or by the Board of Aldermen under its provisions, such vacancy
to be filled by the acting Aldermen."
After a full discussion of the matter, Mr. Wilde moved that the following per-
sons be appointed to fill the vacancies:

Following Mr. Thrasher's second, a vote was taken and the appointment of
those listed above was unanimously confirmed.
The next matter of business was to provide for the calling of an election
for the officials of the town to be held on April 5, 1969, the first Saturday
in April, as provided by law. Following discussion of the matter, the following
persons were nominated to serve as officers during the election.

Mr. Wilde's motion that the above mentioned be elected was seconded by Mr.
Thrasher. The vote was unanimous in favor of their election to the aforesaid of-
fices.
At the request of Mr. Odom, the following proposed Resolution No. 25 was read
at the meeting:

RESOLUTION NO. 25
WHEREAS, pursuant to the provisions of Title 28, Chapter ll, of the Revised
Civil Statutes of Texas, it is provided that there shall be held in each Munici-
pality in the State of Texas on the first Saturday in April of each year, a general
election for the purpose of electing officers of said Municipality:
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WEST -
LAKE, TEXAS:
I.
THAT the Board of Aldermen of the Town of Westlake, Texas, at a regular
meeting held this date, does hereby order an election of officers -for the Town
of Westlake, Texas, to be held on Saturday, April 5, 1969, for the purpose of
electing a Mayor, five Aldermen and a Marshal, for a term of one year, from
April 5, 1969, or until their -successors are duly elected and qualified. The
candidates for Mayor, Aldermen and Marshal, receiving the highest number of votes
shall be elected to such offices for a term of one year.
II.
FOR the purpose of said election, the entire Town is herebyconstituted one
voting precinct; the polling place for said election shall be the Boat House,
Circle "T" Ranch, within said Town, and said election shall.be held between the
hours of 7:00 A. M. and said 7:OO P. M. on the aforementioned date, and the follow-
ing persons are hereby appointed to act as election officers:

No person shall be eligible for the offices aforementioned unless he is quali-
fied elector of.the Town and has resided in the State of Texas for a period of one
year, and in the Town for six (6) months next preceding the election at which he is
elected.

IV.
ANY eligible and qualified person may have his name printed upon the
official ballot as an independent Candidate for the offices herein provided
for by filing his sworn application with the Mayor not later than Midnight,
March 5, 1969 The application shall state the specific office being
sought by the applicant and that the applicant is eligible and qualified under
the laws of the State of Texas, to become a candidate for and hold the office
being sought, if elected.
V.
(A) The form of the sworn application shall be substantially as follows:

I, , hereby make application
to have my name printed on the official ballot as an
independent candidate for the office of
, to be voted upon at the Town Elec-
tion to be held on the day of ,
19 ; and I hereby certify that I have resided in
the State of Texas for at least one year and in the Town
of Westlake, Texas, for at least six months prior to the
date of such election, and am qualified to make this ap-
plication and that I am legally qualified to hold such
office, if elected.

(B) Such sworn application may be accompanied with a petition signed by
qualified electors, although such petition is not required.
(c) Such sworn application shall be accompanied with an executed copy
of the "Loyalty Affidavit" as required by Article 6.01(2) 1951 Election Code
in Vernon's Texas Civil Statutes, in substantially the following form:

present representative form of government, and if elected,
I will support and defend our representative form of govern-
ment and shall resist any effort to movement from any part

Laws of the United States and of the State of Texas.

VI.
In the event five (5) per cent or over the qualified voters of the Town
(of the entire votes cast in the Town at the last General Election) nominate a
Candidate for either of the offices herein provided by petition signed by such
voters, such Candidate may have his name printed upon the ballot by filing his
sworn application, accompanied by the Loyalty Affidavit as hereinabove set out,
with the Mayor not later than Midnight, March 5 ,19 69

VII.
The names of all those who have filed their sworn applications to have
their names printed on the official ballot as well as those that are nominated
by petition, as candidates shall be posted by the Town Secretary in a conspicuous

Any person eligible to the offices herein provided for who has filed
his sworn application in accordance with the provisions of this resolution,
or who is nominated to any office by petition, shall have his name printed
on the official ballots. Any such person may cause his name to be withdrawn
at any time before the official ballots are printed, by filing in writing with
the Town Secretary a request to that effect over his signature, duly attested
to by a Notary Public. No name so withdrawn shall be printed on the ballots.
IX.
The ballots to be used in said election shall be prepared in the manner
and form as provided in the election code of the State of Texas enacted by the
1951 Legislature. .
X.
All qualified voters within the meaning of the Constitution and Laws of
the State of Texas, who have resided in the State of Texas for a period of on -
year, and in the Town of Westlake for a period of six months prior to the date
of the election herein provided for shall be entitled to vote at such election.
XI.
Voting by absentee ballot in said election shall commence on March 17 ,
19 69 , at the office of the Town Secretary, Westlake, Texas. Voting by absentee
ballot shall close at 5 P. M., Agril 1 . 1969
XII.
The election officers above named shall make and deliver the returns of
said election in triplicate, one being retained by the presiding Judge, one de-
livered to the Mayor of the Town, and one delivered to the Town Secretary. The
ballot box containing the signature stubs from ballots used in said election

shall be delivered to the District Clerk of Tarrant County, Texas, and other
ballot boxes and election records and supplies shall be preserved by the Town
Secretary in the proper office as by law provided. The Board of Aldermen will
meet not less than five and not more than seven days following said election
for the purpose of canvassing the returns of said election.
XIII.
The Mayor is hereby directed to give notice of said election which
shall be signed by the Mayor under the attest of the Town Secretary, and shall
state the purpose of the election, the Officers to be elected, and the Marshal
shall post a properly executed copy of the election proclamation at the polling
place herein provided and two copies at two other public places within the Town.
Such notices shall have attached thereto a certified copy of this resolution.
XIV.
Said election shall be held and conducted in accordance with the laws of
the State of Texas for the holding of General Elections for State and County
Offices except as otherwise provided by Chapter 11, Title 28, and the 1951 Elec-
tion Code of the Revised Civil Statutes of Texas.

ORDER AND NOTICE OF TOWN ELECTION
ELECTION ORDER
I, B. A. ZWALT, Mayor of the TOWN OF WESTLA.KE, TEXAS, by virtue.of the power
vested in me by law, do hereby order that an election be held in the Town of West-
lake, Texas, on April 5, 1969, being the first Saturday thereof, for the purpose
of electing the following officers of said Town:
A Mayor, five Aldermen and a Marshal, for a term of one year, from
April 5, 1969, or until their successors are duly elected and quali-
fied. The candidate for Mayor, five Aldermen and Marshal receiving
the highest number of votes shall be elected to such offices for a
term of one year;
And, that said election shall be held at the Boat House, Circle "T" Ranch, in said
Town, and the following named persons are hereby appointed Managers thereof, to -
wit:
Mrs. Ethel Odom Presiding Judge
Mrs. Betty Cathey Asst. Presiding Judge
and Clerk
ELECTION NOTICE
The Marshal is hereby directed and instructed to post a properly executed
copy of this Order and Notice of Election at the Boat House, Circle "T" Ranch,
the place where this election will be held, and at two other public places within
the Town. Said Notice shall be posted 30 days before the date of said election.

Upon Motion duly made by Mr. Thrasher and seconded by Mr. Wilde, the fore-
going form of order and notice of town election was unanimously approved.
Mr. Shytles informed the Aldermen that they would be advised as to the date
and place of the swearing in of the newly appointed Town Officials.
Maps of Westlake were distributed to the Aldermen by Mr. Shytles, and dis-
cussion centered on the location of a city limits sign bearing the name "South -
lake" which had apparently been placed at the side of Highway 114 within the
bounds of Westlake.
There being no further business to come before the meeting, it was upon
motion duly made and seconded, resolved to adjourn.
